El caso examina dos sentencias contradictorias: la primera instancia declaró fundada la demanda al determinar que el demandado carecía de título válido que justificara su posesión; mientras que la segunda instancia revocó dicha decisión, considerando que el usufructo constituido a favor de la madre del demandado se extendía automáticamente a este último por convivencia familiar. El análisis crítico demuestra que la segunda sentencia incurre en errores jurídicos al aplicar razonamiento analógico sobre derechos personalísimos, desnaturalizando su esencia intransferible. Se concluye que la posesión del demandado configura ocupación precaria conforme al artículo 911 del Código Civil, al carecer de título directo que legitime su permanencia en el inmueble, especialmente considerando que la usufructuaria no residía en el bien al momento de la demanda. El estudio resalta la importancia de una correcta interpretación normativa para garantizar la seguridad jurídica y la tutela efectiva del derecho de propiedad.This paper analyzes Case File No. 07412-2023-01801-JR-CI-33, an eviction proceeding for precarious occupation that evidences the problems arising from an inadequate interpretation of the legal concepts of usufruct, use, and habitation. The case examines two contradictory rulings: the first instance upheld the claim, determining that the defendant lacked a valid title justifying his possession; while the second instance reversed this decision, considering that the usufruct established in favor of the defendant's mother extended automatically to the latter due to family cohabitation. The critical analysis demonstrates that the second ruling contains legal errors by applying analogical reasoning to highly personal rights, distorting their inalienable nature. It is concluded that the defendant's possession constitutes precarious occupation pursuant to Article 911 of the Civil Code, as he lacks a direct title legitimizing his continued occupancy of the property, especially considering that the usufructuary did not reside on the property at the time the lawsuit was filed.
