C, del Texto Único Ordenado del Decreto Legislativo N° 728 correspondiente a la Ley de Productividad y Competitividad Laboral. En la primera y segunda instancia del proceso el juez se resolvió fundada en parte, es por ello que el MIDIS vio como necesidad interponer un recurso de casación. En el desarrollo de esta etapa el MIDIS, alegó que el cambio del lugar del centro de trabajo del señor Jeri, se realizó de forma legal, objetiva y sin vulneración de sus derechos por motivo de falta de certificación OSCE por parte del trabajador para el desarrollo de las funciones para el área en el que se le estaba transfiriendo dentro de su misma sede por motivo que el trabajador mantenía un perfil poco ético y disciplinaria, por tal motivo se realiza dicho acto de traslado que se encuentra dentro de los límites del IUS VARIANDI. El ende encargado concluyó fundado la casación interpuesta, revocando así las resoluciones de las sentencias anteriores; de esta manera manifestó que el cambio de sede de una ubicación a otro se encuentra dentro de las competencias del empleador, acción que no tiene figura de vulneración de algún derecho laboral del empleado y no representa una acción laboral hostil. Por lo mismo, la interpretación del IUS VARIANDI es correcta, ya que el empleador tiene la facultad de realizar modificaciones que permitan una eficiencia para el logro de sus objetivos sin perjudicar a los empleados.This case involves Cassation Appeal No. 07620-2022 Lima, initiated by the Ministry of Development and Social Inclusion (MIDIS) against Jorge Jeri Juscamaita. Mr. Jeri had claimed to be a victim of workplace hostility perpetrated by his employers following his transfer from the San Isidro district office to the La Molina office an action he characterized as an act of workplace hostility under Article 30, subsection (c) of the Consolidated Text of Legislative Decree No. 728 the Productivity and Labor Competitiveness Law. In the initial and appellate stages of the proceedings, the rulings were partially in favor of the plaintiff; consequently, MIDIS deemed it necessary to file an appeal for cassation. During these proceedings, MIDIS argued that the relocation of Mr. Jeri’s workplace was carried out legally and objectively, without violating his rights. The Ministry contended that the transfer—which occurred within the same headquarters—was necessitated by the worker's lack of the required OSCE certification for the functions of the new area, as well as concerns regarding his ethical and disciplinary profile. Thus, the transfer fell within the legitimate scope of the employer's *ius variandi* (the right to modify working conditions). The adjudicating body ruled in favor of the cassation appeal, thereby overturning the previous judgments. It held that relocating an employee from one site to another falls within the employer's authority; such an action does not violate the employee's labor rights nor does it constitute an act of workplace hostility.
