Meza Huamaní, Jhover WaldoQuintanilla Watanabe, Toshiro Alberto2025-10-292025-10-292025-09-12https://hdl.handle.net/20.500.13053/14514Al respecto, es preciso señalar que, el presente caso inicia en las circunstancias que, mediante el Oficio N° 153-2024-REGPOL-LIMA/DIVPOL-C-2/CSL-SEINCRI, la Comisaria PNP San Luis puso en conocimiento del 4° Despacho Penal Provincial de la 2° Fiscalía Penal Corporativa de la Victoria – San Luis, el fallecimiento del agraviado entre el cruce del Jr. Yen Escobedo con el Jr. Río Rímac en el distrito de San Luis, provincia y departamento de Lima. Posteriormente, recibida la comunicación de la Comisaría PNP San Luis, el Cuarto Despacho Provincial Penal de la Segunda Fiscalía Penal Corporativa de la Victoria – San Luis, conforma la Carpeta Fiscal N° 506054502-2024-183-0, con ello emitió la Disposición Fiscal N° 01-2024-MP-FN de fecha 22 de enero de 2024, a través del cual, entre otros, dispuso dar inicio a las diligencias preliminares en sede policial (DEPINCRI LA VICTORIA – SAN LUIS) con la finalidad inmediata de realizar los actos urgentes e inaplazables para asegurar los elementos materiales del presunto delito. Asimismo, el Cuarto Despacho Provincial Penal de la Segunda Fiscalía Penal Corporativa de la Victoria – San Luis, emitió la Disposición Fiscal N° 03-2024-MP-FN de fecha 23 de enero de 2024, mediante el cual dispuso, entre otros, formalizar y continuar con la investigación preparatoria por un plazo de ciento veinte (120) días, por cuanto luego de realizarse las investigaciones preliminares lograron recabar los elementos de convicción suficientes, que configuraron indicios de la presunta comisión de los delitos tipificados y el vínculo causal con los imputados. En ese mismo contexto, mediante Requerimiento Acusatorio N° 12-2024-LIMA-4DPP/2FCP-LV-SL dirigido a la señora Juez del Tercer Juzgado de Investigación Preparatoria – sede La Victoria, la precitada Fiscalía formuló su acusación. Consecuentemente, el Tercer Juzgado de Investigación Preparatoria – Sede La Victoria, emitió la Resolución N° 02 de fecha 8 de julio de 2024, a través del cual, entre otros, resolvió formar el cuaderno de la Etapa Intermedia con el precitado Requerimiento Fiscal de Acusación, los pedidos que realicen los sujetos procesales, las resoluciones que dicte el Órgano Jurisdiccional, así como las actas que registren las actuaciones judiciales, disponiendo que la carpeta fiscal sirva como anexo al cuaderno de la etapa intermedia y para lo que corresponda por ley. Finalmente, mediante Resolución N° 3, emitido por el Primer Juzgado Penal Colegiado Permanente de Lima de la Corte Superior de Justicia de Lima, se impuso al imputado Jhonatan Alessandro Flores Huamanyauri, seis (6) años de pena privativa de la libertad con el carácter de efectiva y respecto del imputado José Manuel Biorggio Macedo, se reservó el fallo, ordenando a la Policía Judicial su inmediata ubicación, captura y puesta a disposición.In this regard, it is necessary to point out that the present case begins in the circumstances that, through Official Letter No. 153-2024-REGPOL-LIMA/DIVPOL-C-2/CSL SEINCRI, the San Luis PNP Commissioner informed the 4th Provincial Criminal Office of the 2nd Corporate Criminal Prosecutor's Office of Victoria - San Luis, of the death of the victim between the crossing of Jr. Yen Escobedo with the Jr. Río Rímac in the district of San Luis, province and department of Lima.
