Es necesario establecer la responsabilidad civil bancaria porque muchas personas son víctimas del hurto por medios informáticos, y nuestra legislación no es de ayuda suficiente para resolver este conflicto, la responsabilidad bancaria muy pocas veces se hace cargo desprotegiendo al consumidor. Este estudio es de tipo jurídico, se usó la metodología cualitativa, con diseño descriptivo, con análisis inductivo. Se concluye que se debe establecer la responsabilidad civil bancaria contractual y no Extracontractual dependiendo del caso particular.The objective of this research is to determine the bank's civil liability against theft by computer means, for which it is proposed to do so by objective theory. It is necessary to establish bank civil liability because many people are victims of theft by computer means, and our legislation is not helpful enough to resolve this conflict, bank liability is rarely taken over by unprotecting the consumer.
