    This research is descriptive, the approach used is mixed between quantitative and qualitative; it was used as methods, analytical, synthesis and dogmatic. The primary objective has been to determine the results of the toxicological expertise in crimes related to drunk driving according to the ethyl dosage in blood samples and counter samples in the Tacna 2020 region. know the importance of toxicological expertise to know the level of alcohol in the blood of people intervened while driving while intoxicated, for this a hundred certificates of ethyl dosage of the year 2020 have been collected from the city of Tacna, said information it is very relevant since the legal situation of the intervened person depends on it, which may merit a criminal sanction or be acquitted. The result of the toxicological expertise determines the amount of alcohol in the blood of a person and of the 100 samples obtained, ninety-seven had excess alcohol in the blood in the first result and only three intervened were below the allowed limit. In the case of the counter samples, which is the second result of the same intervened, only seven intervened varied below the legal minimum, that is, if in the first result it was an excess of alcohol in the blood, in the second result it decreased to 0.5 or maintained which according to the Penal Code is not punishable.
