Publicación Acceso abierto Valor probatorio de la pericia psicológica en la investigación fiscal en delitos de violencia psicológica, Lima 2025(Universidad Privada Norbert Wiener, 2026-03-20) León Aparicio, Elvia Susy; Delgado Ramos, EdgardoThe research successfully established the relationship between the evidentiary value of psychological expert testimony and prosecutorial investigations into psychological violence in Lima, 2025. This was achieved through a quantitative approach, employing a hypothetical deductive method, a non-experimental, cross-sectional, and correlational design. Data was collected using a Likert-scale survey questionnaire from a sample of 62 justice system professionals: 28 prosecutors and 34 assistant prosecutors working in the Lima Family Prosecutor's Office. The results showed that the evidentiary value of psychological expert testimony has a moderate positive correlation (ρ = 0.434; p = 0.000) with prosecutorial investigations into crimes of violence. Similarly, the scope of psychological expert testimony also shows a moderate positive correlation (ρ = 0.359; p = 0.000) with the manifestations of psychological violence. It is concluded that psychological expertise is not an accessory element, but a strategic element that reinforces the objectivity and solidity of the prosecutorial function and finds its probative effectiveness conditioned on the existence of technical protocols, specialized training and regulatory articulation; that the technical and methodological weakness reduces the strength of the expert report, there is a gap between norm and practice, for which reason the regulations must be complemented with dynamic technical criteria to have real effectiveness; methodological quality being a conditioning factor to probative effectiveness influencing the prosecutorial argument.
