Publicación Acceso abierto Análisis de la supremacía constitucional de los derechos fundamentales en materia laboral individual en las sentencias del Tribunal Constitucional durante el periodo 2007-2016(Universidad Privada Norbert Wiener, 2020-01-18) Lora Brenner, Carlos Armando; Tafur Portilla, Raúl ArturoThe present investigation is based on determining the relationship between the Constitutional Supremacy and the sentences of the Constitutional Court, in individual labor matters, for which a general negative hypothesis has been formulated, while it is proposed that the sentences of the Constitutional Court in Individual labor matters are not related to the concept of Constitutional Supremacy, since for its drafting the fundamental labor rights protected by the Magna Carta are not considered. In order to carry out this investigation, the Constitutional Court judgments in individual labor matters, from 2007 to 2016, which total 759 sentences and a sample of 86 sentences of the referred period have been taken as a population. Two qualitative variables have been considered, the first referring to the constitutional supremacy of fundamental labor rights and the second variable concerning the judgments of the Constitutional Court in individual labor matters. For the purposes of the investigation, variable 1, constitutional supremacy of fundamental rights in labor matters, has been operationalized, which is operationalized in two dimensions on the application of standards, in the same way variable 2, judgments of the Constitutional Court in labor matters individual, in five dimensions, that constitute the fundamental constitutional labor rights that are protected in the amparo process that are raised by affectation to this type of rights; For this, the right to dignity, work as duty and right, the right to equal opportunities without discrimination, the right to the inalienable nature of the rights recognized by the Constitution and the law, and the right to interpretation have been considered favorable to the worker in case of insurmountable doubt about the meaning of a norm. For the purposes of data collection, a Data Collection Card has been prepared, in order to record the results values of the indicators, which consist in the application or not of the fundamental rights in the text of the sentences, obtaining dichotomous results. From the result of the collection of the information obtained, making the verification of these data, it has been found that only 25.58% of the component judgments of the sample base their position on a fundamental right, of which 9.1% apply for resolution of the sentence constitutional principles, which is equivalent to two sentences out of a total of 22 sentences. On the other hand, it is found that 45.5% of sentences that are part of this group of sentences that base their position on a fundamental right, apply norms with the rank of law in their livelihood. By these data it is confirmed that the sentences of the Constitutional Court in individual labor matters, have no constitutional basis in their foundations, confirming the general hypothesis raised, although statistically it has been found that the database worked is not significant.Publicación Acceso abierto La expresion artistica como estrategia pedagógica para superar problemas de aprendizaje en el proceso de lecto escritura en estudiantes de básica secundaria de la Institución Educativa La Vega sede A, del Municipio de Piedecuesta, Departamento de Santander, Colombia(Universidad Privada Norbert Wiener, 2019-05-08) Montalvo Guevara, Olga Lucía; Rodríguez Bernal, Néstor Henry; Tafur Portilla, Raúl ArturoThe research carried out addressed learning problems that are presented in the classroom, the dyslexia and how this affects the school performance of pupils and students, and the use of techniques using artistic expression as a pedagogical strategy, helps to overcome the problem dyslexia. The type of study is correlational as it investigates as an independent variable (techniques of artistic expression) and another dependent (dyslexia), relate to their behavior in students and determine how they affect each other. The research is also descriptive because the learning problems are characterized around the reading writing, in particular of the dyslexia, indicating its most peculiar or differentiating features, through an enumeration of them. The project was implemented in the Educational Institution La Vega, in courses related to basic secondary campus Piedecuesta, Santander. Could be through interviews, surveys and observations revealed that a significant percentage of students of that level had problems of this nature. The researchers propose using this project with other teachers for the use of techniques of artistic expression as a leisure activity and teaching strategy optimally to improve school performance, and in particular to improve academic achievement and self-esteem of students with dyslexia. As the main result of the research it was established that formulating different means of expression of the graphic-plastic language using different possibilities and combinations, is a good tool to overcome the problem of dyslexia, with respect to writing and reading, in this way strengthen the performance of the affected community in its learning process. In addition, with the application of techniques of artistic expression as an intervention strategy can provide teachers and parents, criteria and pedagogical strategies to control dyslexia in students who suffer, also help students to have a better self-esteem and social development. Unfortunately, the learning of Social Sciences for most students has become a little motivating, training and enriching process that allows to assume from other perspectives the applied knowledge of this area in the daily life of each one of the students. In this sense, it was necessary to implement a pedagogical proposal: ICT through the use of Virtual Learning Objects, which allowed access to Social Sciences with a more integrative vision, contrasted to individual, social and global realities. A research project was developed that started from the students' own interests in the area of Social Sciences, proposing a proposal focused on the OVA, as teaching tools that can favor the teaching - learning processes and the impact of these on work. cooperative and collaborative. The research process was quantitative experimental, through a control course group and an experimental one to which the OVA-based pedagogical strategy was applied, which later evidenced the contrasts in achieving a better learning process. This panorama motivated the interest to find out the causes of the problem because the results will allow to design educational programs using Virtual learning environments that allow to overcome the learning difficulties observed. In this sense, the present study aims to determine how the design and implementation of virtual learning environments influences the learning of mathematics in the students of the sixth grade baccalaureate of the industrial technical educational institution Gerardo Valencia Cano; tries to answer the question How does the use of virtual environments of learning in the learning of mathematics in the students of the sixth grade of the baccalaureate of the industrial technical educational institution Gerardo Valencia Cano Influence? It was assumed that the use of virtual learning environments significantly improves math learning in students in the sixth grade students of the industrial technical education institution Gerardo Valencia Cano. The population was made up of sixth grade students, and the sample of 22 students. The research design is experimental. The instruments applied were the pretest evaluation of math learning and the posttest test through the use of virtual learning environments. The instrument was validated by expert judgment with an average rating of 90% and with the reliability coefficient of Küder Richardson, the instrument was found to be reliable (f = 0.65). The results show that the use of virtual learning environments significantly influences math learning; Student's t-test calculated a difference of -15,870, significant at .000 (** p <.01). In theoretical terms, to establish the basic definitions of the research is that they favor the development of pedagogical practices in the classroom with support of Virtual Learning Environments. (2010), Orantes (1980), Herrera (2006), Olguín (2010), Asencio (2008).Publicación Acceso abierto Uso de las TIC para incrementar la calidad educativa en la Institución Educativa Santa María Goretti de Bucaramanga-Colombia en el año 2017(Universidad Privada Norbert Wiener, 2018-10-12) Arenas Gutiérrez, Sandra Milena; Tafur Portilla, Raúl ArturoThis thesis investigates the use of ICT in the Educational Institution Santa María Goretti in the city of Bucaramanga (Colombia) in 2017, analyzing the impact that it has on educational quality in coherence with the demands, transformations and projections of the society of the 21st century, century of information and knowledge. In this sense, the use and appropriation of information and communication technologies - ICT by the educational actors of the institution, in the technical, management, pedagogical and social dimension is considered as a fundamental element in educational quality. The Santa Maria Goretti school has excellent technological tools in each classroom, which have been incorporated into the educational dynamics since 2014; today, 100% of classrooms and laboratories have video beam, active 300-watt sound booths, lapel microphone and headset, electric screens of 280 x 220 and fiber optics. Teachers and managers have been trained in various topics of ICT. Taking into account these particularities, the objective of this thesis is to determine how the use of ICT in its different dimensions contributes to raising the educational quality in the Educational Institution Santa María Goretti de Bucaramanga, in the year 2017, hoping these technologies has been incorporated into educational practice, in its technical, managerial, pedagogical and social dimensions and have contributed to improving quality in its dimensions (accessibility, relevance, didactic forcefulness, integrating policy, promotion of universal values and principles, development of technological competences [ in students and teachers] and academic linkage), although it is also considered that the existence of technological resources in EI does not guarantee adequate and pertinent use in favor of the quality of their educational processes.
