Publicación Acceso abierto Valoración de los peritajes psicológicos y decisiones judiciales sobre violencia sexual en el juzgado de Tarapoto, 2022(Universidad Privada Norbert Wiener, 2024-03-18) Villar Briceño, Elvin; Montellanos Cabrera, Henry SamThe objective of this study was to determine the relationship between the valuation of psychological expert opinions and judicial decisions on sexual violence in the Tarapoto Court, 2022; we worked with a hypothetical-deductive method, as the statistical method made possible the interpretation and analysis of quantitative data using mathematical and statistical rules, procedures, and processes, as well as a quantitative approach, non-experimental, descriptivecorrelational design. The research sample will be composed of 20 people (10 criminal lawyers, 5 justice operators and 10 psychological experts). After the analysis of the data, it has been obtained as a result that a significant percentage (40%) does not consider that the assessments of the psychological expert opinions are performed at a high level, while the judicial decisions, in general, have been shaped in accordance with the criteria at a high level (76% of agreement in the sentencing decision). It has been shown that technical-scientific study and analysis are significantly related to judicial decisions in cases of sexual violence. This supports the hypothesis that sound technical-scientific analysis influences judicial decisions in a statistically significant manner. In summary, there is a significant relationship between valuation and judicial decisions, emphasizing the importance of experts developing an objective and evidence-based valuation process. This has a direct impact on decisions in criminal proceedings.
