Los conflictos socioambientales de las comunidades campesinas y la influencia en la gobernabilidad de la región Apurímac, 2018-2019

The study of socio-environmental conflicts in rural communities and governance in Apurímac region 2018-2019, has been carried out in a context where socio-environmental conflicts are growing due to the lack of answers from the government. The main objective of this research is to determine the relationship between socio-environmental conflicts and governance in Apurímac region. The deductive method is used, with a quantitative approach of an applied type and correlational design with a sample of 219 community and social leaders to whom the questionnaire was applied. In this research, it was determined that there is a direct, high and significant relationship between the variables socio-environmental conflicts and governance, according to the results (Rho = 0.993, "p" = 0.000). This is an evidence that conflicts are inherent to human beings and they are showed because they are structural, permanent and dynamic in the management of limited natural resources in a society of increasing demand for needs. The struggle for control, use, access and distribution claim for the government´s intervention and try out the principles of governance that are efficiency, stability and legitimacy.

Los Derechos Humanos en la protesta como manifestación pacífica en Lima Metropolitana, 2020 -2023 (EXP N°01492-2022-PHC/TC)

Introducción: En Perú, diversos grupos como comunidades indígenas, rurales y trabajadores protestan para cambiar políticas que afectan a la población, generando conflictos con las fuerzas de seguridad y exigiendo ser escuchados. Objetivo: Identificar cómo influyen los derechos humanos en las protestas como manifestaciones pacíficas en Lima, durante el periodo 2020-2023, considerando el contexto social y político. Metodología: La investigación es cualitativa, con un enfoque inductivo. El diseño es un estudio de caso, empleando el análisis del Expediente N.° 01492-2022- PHC/TC, que aborda aspectos legales y de derechos fundamentales. Como resultado: evidenciaron que las manifestaciones pacíficas son fundamentales para los derechos humanos, pero los conflictos con la policía generan violencia y tensiones. En conclusión: Los derechos humanos son esenciales en las manifestaciones pacíficas, ya que garantizan la libertad de expresión y reunión, fortaleciendo la democracia y la sociedad civil. Es crucial lograr un equilibrio entre la protección de estos derechos y la preservación del orden público, asegurando al mismo tiempo la protección de los derechos de todos los ciudadanos. Para ello, se debe promover un diálogo constructivo entre las partes, lo que contribuirá a una gestión más pacífica y efectiva de las protestas.

Significado de la declaración jurada de intereses desde la experiencia del personal de la Entidad Fiscalizadora Superior del Perú, 2023

The objective of the study was to understand the significance of the sworn statement of interests from the perspective of the staff of the Superior Audit Institution of Peru in 2023. A qualitative approach with a phenomenological design was employed. The study setting was the Superior Audit Institution of Peru, specifically the Audit Sub-Management, and the participants were 10 public servants who conduct audits of the sworn statement of interests. These participants were interviewed using an original semi-structured interview guide validated by an expert. The results showed that the sworn statement of interests is the primary tool for the audit work carried out by the participants. It is seen as an important instrument in strengthening public integrity and transparency, all aimed at combating corruption by preventing and detecting conflicts of interest. However, the participants emphasized the need for public employees required to submit this sworn statement to provide complete and truthful information. This act is also a display of integrity, as it demonstrates honesty and truthfulness in the information included in their sworn statements. Additionally, it was concluded that the participants feel aligned with the mission of the Superior Audit Institution of Peru and its corporate and individual values, which also guide their audit work. Their functional duties are governed by certain ethical principles.
