Evaluación de los informes técnico policiales en los delitos por accidentes de tránsito en el Callao, 2023

The main objective of this research work was to evaluate how police technical reports contribute to traffic accident crimes in Callao, 2023. The method used in this research was hermeneutical, with a qualitative approach, phenomenological design, taking as a sample to the population of 08 specialists to examine the reasoning and rigor of the respective examination of police technical reports on traffic accidents. On the other hand, 2 prosecutors, 2 police officers, 2 trial lawyers and 2 experts with experience in traffic cases were interviewed. The instrument was applied to them, this being an-interview; the Atlas Ti-Version 9 program was used for data analysis. Having carried out the analysis as results, it can be seen that to evaluate how police technical reports contribute to crimes due to traffic accidents in Callao, 2023, five important axes were identified: which are detailed below: 1. The transcription of the occurrence. 2. The analytical description. 3. The conclusions. 4. Traffic accidents in the crimes of injuries and manslaughter. Likewise, it was concluded that there are deficiencies and errors in the police technical reports that could trigger problems in the investigation and a criminal process not in accordance with current criminal regulations and the rules that govern our legal system, which would generate acquittals or convictions. wrong. Factores de riesgo en el procesamiento de la escena de crimen y su asociación con la responsabilidad penal por hechos de tránsito en la provincia de Tambopata-2020

The present investigation was carried out with the objective of determining how risk factors in the processing of the crime scene are associated with the criminal responsibility of culpable crimes due to traffic events in the Province of Tambopata2020. It was a non-experimental, cross-sectional investigation with a descriptivecorrelational design. The population sample was made up of 62 specialists related to crime scene processes in traffic offenses in the Province of Tambopata. Among the results, for 32.2% of the specialists interviewed, the basic staff of the police station almost never adequately protects the crime scene. 17.7% and 42% of those interviewed stated that, between never and almost never, firefighters and serenade personnel enter the crime scene with due caution. For 43.5% and 38.8% of specialists, the specialized unit in traffic accident investigation of the National Police of Peru never and almost never has modern criminalistics equipment. For 4.8% and 25.8%, the criminal measures are never and almost never the pertinent ones according to the evidence found. For 4.8% and 19.4%, the evidence found never and almost never tends to a fair criminal law. The risk factors in the processing of the crime scene are significantly associated with the criminal responsibility of culpable crimes due to traffic events in the Province of Tambopata.

En el presente trabajo de investigación analicé el expediente N°00179-2021-0-2802-JP-CI-02, referido a un proceso de indemnización por daños y perjuicios derivados de un accidente de tránsito ocurrido el 02 de noviembre de 2020, la finalidad del presente trabajo es comprender la aplicación práctica de la responsabilidad civil extracontractual en el ordenamiento jurídico, la demanda fue interpuesto por Doña Paola Lorena Ordoñez en contra de la empresa HVAC ELECTRIC SRL y el conductor Dario Pilco. A lo largo del estudio examiné los hechos relevantes, las actuaciones procesales, los medios probatorios ofrecidos y las decisiones emitidas en primera y segunda instancia. Asimismo, analicé los fundamentos constitucionales, civiles y procesales relacionados con la tutela jurisdiccional efectiva, la carga y valoración de la prueba, el nexo causal y la responsabilidad objetiva aplicable a los accidentes de tránsito. El análisis del expediente permitió evidenciar deficiencias en la motivación de la sentencia de primera instancia, especialmente en la valoración probatoria y en la determinación del nexo causal, las cuales fueron corregidas por la segunda sala civil, declarándose finalmente fundada en parte la demanda; asimismo concluyo que la indemnización cumple una función resarcitoria y protege derechos fundamentales mediante una adecuada motivación judicial efectiva.

The problem detected in this unit was the increase in traffic accidents caused by drivers who were within the subclinical period of drunkenness (with values less than 0.50 g/l. zero grams, fifty centigrams of alcohol in blood), which according to the current legislation implemented in our country, are not usually penalized; The general objective was to establish the relationship between the subclinical period of drunkenness and traffic accidents, in the forensic chemical expertise of the decentralized alcohol dosing unit of Abancay during the years 2021-2022; The methodology was developed based on the quantitative approach, applied type, cross-sectional non-experimental design, correlational level, the sample consisted of 101 certificates that were selected by non-probability sampling for convenience and the technique used was documentary analysis and the instrument was a data collection sheet of 10 items that complement each other; The results revealed that the subclinical period of drunkenness is not significantly related to the crash, distraction and run over in the forensic chemical appraisal of the decentralized alcohol dosage unit of Abancay; The most representative conclusion was that the subclinical period of drunkenness is not significantly related to traffic accidents, with a Spearman's rho coefficient (0.074) and bilateral significance of 0.463, a value that was greater than the assumed error of 0.05.
