Análisis técnico de la reconstrucción de los accidentes de tránsito y la responsabilidad penal en el Distrito de Echarati, 2019-2022

The purpose of the investigation was to know the effects that the implementation of the technical analysis of the reconstruction of traffic accidents would have on the determination of criminal responsibility in the district of Echarati - Cusco; 2019-2022, the same one that was carried out under the qualitative approach with a phenomenological design. The techniques used have been the documentary analysis of five police reports of reconstruction in traffic accidents and the interview of five specialists, whose selection criteria have been based on their specialty and field of action, for which reason, they have been part of the sample, two experts specialized in traffic accidents from the Traffic Accident Prevention and Investigation Unit – UPIAT Cusco; an expert in traffic accidents from the PNP Echarati Police Station; and two magistrates of the Judiciary specializing in criminal law, which allows us to show a high level of reliability for the results found. From the results of the present investigation, it has been possible to establish that the reconstruction of traffic accidents is very important to establish the criminal responsibility of the defendants; however, due to the lack of preparation of the intervening police officers, an adequate treatment of the evidence found in the event is not carried out; in the same way, a perpetuation of the transit event is not carried out that prevents the alteration of the scene until the arrival of the experts; consequently, the phases of the transit event are not determined; what causes, the loss of evidence; which causes the reconstruction to be incomplete and historical.

The present investigation was formulated as a general problem: How does photogrammetry with unmanned aerial vehicles favor civil forensic investigation in works with areas of difficult access? Likewise, the general objective was: Determine how photogrammetry with unmanned aerial vehicles favors investigation civil forensic investigation of works with areas of difficult access, the general hypothesis was: Photogrammetry with unmanned aerial vehicles favors civil forensic investigation of works with areas of difficult access. The general research method was scientific, the specific research method was Inductive - Deductive, inductive because it allows reasoning based on a particular case to rise to general knowledge, and deductive because it allows reasoning to be used to obtain general conclusions for particular applications. (Pineda E. Alvarado E. ed. Al. 2008). The sample consisted of 80 expert reports where research work was carried out with areas of difficult access, which are: construction works, hydraulic works, road works and structures. The conclusion was reached: that photogrammetry in forensic civil investigation favors improving the times in the collection of information of indications and/or evidence, highlighting that 49.40% of forensic civil investigations were carried out indirectly because the works were found in inaccessible, insecure or difficult to access places and these were carried out with the help of an unmanned aerial vehicle (DRON). Likewise, the photogrammetry carried out in construction works is associated with the angle of inclination of the drone camera where the test of independence of variables (Chi-square) found p-value=0.018<0.05.

Periodo subclínico de embriaguez y su relación con siniestros de tránsito, en el peritaje químico forense de la unidad desconcentrada de dosaje etílico Abancay 2021-2022

The problem detected in this unit was the increase in traffic accidents caused by drivers who were within the subclinical period of drunkenness (with values less than 0.50 g/l. zero grams, fifty centigrams of alcohol in blood), which according to the current legislation implemented in our country, are not usually penalized; The general objective was to establish the relationship between the subclinical period of drunkenness and traffic accidents, in the forensic chemical expertise of the decentralized alcohol dosing unit of Abancay during the years 2021-2022; The methodology was developed based on the quantitative approach, applied type, cross-sectional non-experimental design, correlational level, the sample consisted of 101 certificates that were selected by non-probability sampling for convenience and the technique used was documentary analysis and the instrument was a data collection sheet of 10 items that complement each other; The results revealed that the subclinical period of drunkenness is not significantly related to the crash, distraction and run over in the forensic chemical appraisal of the decentralized alcohol dosage unit of Abancay; The most representative conclusion was that the subclinical period of drunkenness is not significantly related to traffic accidents, with a Spearman's rho coefficient (0.074) and bilateral significance of 0.463, a value that was greater than the assumed error of 0.05.

La toxicología forense y su aporte al dosaje etílico en la investigación de accidente automovilísticos a cargo de la policía nacional del Perú en el distrito de Huacho Huaura. Lima. 2021

This research focused on determining the relationship of forensic toxicology in the ethyl alcohol dosage in the investigation of automobile accidents in charge of the National Police of Peru in the district of Huacho, in the city of Lima during the period 2021. The research methodology used corresponded to a hypothetical-deductive method, whose design was non-experimental in a study group, the sample consisted of 80 specialists from the Criminal Investigation Center and PNP health personnel, which is a census-type sample since the population is equal to the sample. In addition, the approach was quantitative because the data were analyzed statistically and respond to the objectives proposed in the research. The technique was the survey and the instrument used were two questionnaires that were validated through the judgment of experts dedicated to the area of study. Thus, these instruments evaluated the specialists at a single moment, in order to corroborate their knowledge of the research variables. Thus, according to the results obtained, it could be concluded that there is a weak positive correlation between the variables Forensic Toxicology and Ethyl Dose between the specialists of the Criminal Investigation Center and the PNP health personnel and it is also expressed that the significance level between both variables is greater than 0.05 (p>0.05).

Vehículos automotores frente a la tarjeta de propiedad en Junín, 2022

Las diferentes realidades que versan sobre la adquisición de los vehículos automotores menores genera problemas en el trámite de la tarjeta de propiedad .Como objetivo es determinar cuál es el impacto de los vehículos automotores frente a la tarjeta de propiedad en Junín, 2022, de enfoque cualitativo, modo hermenéutico, técnica análisis documental ,estudio fenomenológico basado en el estudio de caso, se recurrió a la técnica de análisis documental .Se obtuvo como resultado que los vehículos automotores tienen un proceso de inscripción riguroso generando que los vehículos no se registren por lo que los compradores y las empresas intermediarias de estos sean los más afectados. Como conclusión se determinó que si existe el impacto de los vehículos automotores frente a la tarjeta de propiedad. Lo más importante de determinar el impacto de los vehículos automotores fue establecer que el estado tiene la responsabilidad de ver aquellas situaciones que se encuentran sin regular. Se tuvo algunas limitaciones como la poca información en doctrina y legislación comparada por lo que se recomienda seguir con esta línea de investigación, a fin de que se pueda reestructurar el reglamento con respecto a la inscripción vehicular.
