La responsabilidad de los accionistas en el cumplimiento de la sanción penal impuesta a la sociedad anónima cerrada

Abstract

Si tomamos en cuenta lo que escribe Abanto, M (2009) sobre el avance que se ha trabajado en el campo de la responsabilidad penal de las personas jurídicas “si se mira bien, los argumentos tradicionales en contra de esta responsabilidad penal no han podido ser desvirtuados desde la perspectiva de la dogmática penal; y ello por una sencilla razón: no solamente la capacidad de culpabilidad sino incluso todas las categorías penales han sido construidas por y para la actividad individual. La imputación penal sigue refiriéndose a personas naturales, aunque se tome para ello, como referencia, el funcionamiento de las organizaciones empresariales (dominio de la organización). se debe reconocer que no sería posible la imputación penal al empresario allí donde el deber quede excluido por haber existido una delegación del deber”. La presente investigación tuvo como objetivo establecer la responsabilidad penal de los accionistas y su relación con el cumplimiento de la sanción penal impuesta a la sociedad anónima cerrada. El estudio corresponde al tipo aplicado y diseño no experimental, la población estuvo representada por los profesionales en derecho penal y la muestra la conformaron 40 abogados. La técnica utilizada fue la encuesta y los instrumentos fueron los cuestionarios. Se aplicó la prueba coeficiente de correlación de Spearman para corroborar las hipótesis del estudio.

The objective of the present investigation was to establish the criminal liability of the partners and their relationship with compliance with the criminal sanction imposed on the legal entity. The study corresponds to the applied type and non-experimental design, the population was represented by professionals in criminal law and the sample was formed by 40 lawyers. The technique used was the survey and the instruments were the questionnaires. The Spearman correlation coefficient test was applied to corroborate the hypotheses of the study.
