Factores socieconómicos y su relación con los elitos conyra los derechos de autor según la legislacion peruana

Abstract

En el artículo N°3, Título I del Objeto del Derecho de Autor, Decreto Legislativo N°822, Ley sobre el derecho de autor se señala que: La protección del derecho de autor recae sobre todas las obras del ingenio, en el ámbito literario o artístico, cualquiera que sea su género, forma de expresión, mérito o finalidad. Los derechos reconocidos en esta ley son independientes de la propiedad del objeto material en el cual está incorporada la obra y su goce o ejercicio no están supeditados al requisito del registro o al cumplimiento de cualquier otra formalidad. Con este marco legal se brinda la protección de los derechos de autor. En nuestro País no toda la población conoce los alcances de esta Ley y, es el argumento que ayudó a desarrollar la presente investigación con el objetivo de establecer el nivel de relación entre los factores socioeconómicos con el delito contra los derechos de autor. El estudio es de tipo aplicado y su diseño es no experimental, la población estuvo representada por los pobladores del Asentamiento Humano Jaime Zubieta Calderón en el distrito de San Juan de Lurigancho y la muestra la representaron 40 personas. La técnica utilizada fue la encuesta y los instrumentos fueron los cuestionarios. Se aplicó la prueba coeficiente de correlación de Spearman para corroborar las hipótesis del estudio.

The rights recognized in this law are independent of the ownership of the material object in which the work is incorporated, and its enjoyment or exercise are not subject to the requirement of registration or the fulfillment of any other formality. With this legal framework protection of copyright is provided. In our country not all the population knows the scope of this Law and, it is the argument that helped to develop the present investigation with the aim of establishing the level of relationship between the socioeconomic factors with the crime against copyright. The study is of applied type and its design is nonexperimental, the population was represented by the inhabitants of the Jaime Zubieta Calderón Human Settlement in the district of San Juan de Lurigancho and the sample was represented by 80 people. The technique used was the survey and the instruments were the questionnaires. The Spearman correlation coefficient test was applied to corroborate the hypotheses of the study.
