Necesidad jurídica de la responsabilidad penal restringida en adolescentes y la prevención para facilitar el delito de sicariato en el Perú, 2017

Abstract

El sicariato es un delito de ferocidad, pues se mata por encargo a cambio de dinero o de prebendas; bien sea por venganza, por despecho, por razones políticas o para castigar a quien no se ha dejado extorsionar. Es un grave problema social que se está haciendo frecuente en cualquier momento y lugar, con un autor que procede con pasmosa frialdad en el convencimiento de su impunidad, de que el sistema legal no lo alcanzará, y lo más preocupante es que un gran porcentaje de sus ejecutores son menores de edad que tienen una responsabilidad jurídica restringida (Chiabra, 2014). La presente investigación tuvo como objetivo evaluar la necesidad jurídica de la responsabilidad penal restringida a adolescentes y su relación con la prevención para facilitar el delito de sicariato en el Perú. La investigación es de tipo aplicada, nivel evaluativo y el diseño no experimental. La población estuvo representada por ciudadanos y abogados de diversas especialidades y la muestra por 100 ciudadanos. La técnica que se utilizó fue la encuesta y los instrumentos, los cuestionarios. Como conclusión, el estudio verificó que existe la necesidad jurídica de la responsabilidad penal restringida a adolescentes y así prevenir la facilitación para facilitar el delito de sicariato en el Perú.

The sicariato is a crime of ferocity, because it is killed by order in exchange for money or perks; Either for revenge, for spite, for political reasons or to punish those who have not been allowed to extort. It is a serious social problem that is becoming frequent at any time and place, with an author who proceeds with astonishing coldness in the conviction of his impunity, that the legal system will not reach it, and most worrying is that a large percentage of its executors are minors who have a restricted legal responsibility (Chiabra, 2014). The objective of the present investigation was to evaluate the legal necessity of criminal responsibility restricted to adolescents and its relation to prevention to facilitate the crime of hired killers in Peru. The research is of applied type, evaluative level and non-experimental design. The population was represented by citizens and lawyers of civil specialty and the sample by 100 citizens. The technique used was the survey and the instruments, the questionnaires. In conclusion, the study verified that there is a legal need for criminal liability restricted to adolescents and thus prevent the facilitation of the crime of hired killers in Peru.
