Análisis técnico de la reconstrucción de los accidentes de tránsito y la responsabilidad penal en el Distrito de Echarati, 2019-2022

The purpose of the investigation was to know the effects that the implementation of the technical analysis of the reconstruction of traffic accidents would have on the determination of criminal responsibility in the district of Echarati - Cusco; 2019-2022, the same one that was carried out under the qualitative approach with a phenomenological design. The techniques used have been the documentary analysis of five police reports of reconstruction in traffic accidents and the interview of five specialists, whose selection criteria have been based on their specialty and field of action, for which reason, they have been part of the sample, two experts specialized in traffic accidents from the Traffic Accident Prevention and Investigation Unit – UPIAT Cusco; an expert in traffic accidents from the PNP Echarati Police Station; and two magistrates of the Judiciary specializing in criminal law, which allows us to show a high level of reliability for the results found. From the results of the present investigation, it has been possible to establish that the reconstruction of traffic accidents is very important to establish the criminal responsibility of the defendants; however, due to the lack of preparation of the intervening police officers, an adequate treatment of the evidence found in the event is not carried out; in the same way, a perpetuation of the transit event is not carried out that prevents the alteration of the scene until the arrival of the experts; consequently, the phases of the transit event are not determined; what causes, the loss of evidence; which causes the reconstruction to be incomplete and historical.

Cadena de custodia de indicios y evidencias en los delitos de homicidios simple, homicidio calificado y lesiones en el distrito fiscal de el Tambo, 2022

The present study had as general objective to determine the relationship that exists between the chain of custody of evidence and the crimes of simple homicide, qualified homicide and injuries in the fiscal district of El Tambo, 2022, based on the general problem: Is there a relationship between the chain of custody of indications and evidence and the crimes of simple homicide, qualified homicide and injuries in the fiscal district of El Tambo, 2022? For this reason, the understanding of how the chain of custody of indications and evidence was developed based on the experience of public servants and prosecutors of the Provincial Criminal Prosecutor's Office of Huancayo was developed and how it is related to crimes of simple homicide, qualified homicide and injuries. The present study had as methodological support the quantitative approach, of a basic or fundamental type, non-experimental design, whose population was made up of prosecutors from the Huancayo Provincial Criminal Prosecutor's Office and police officers who participate in the chain of custody process in crimes of homicide, abortion and injuries; The sample was made up of 80 professionals, including prosecutors and police officers; the technique used was the survey and the instrument was the questionnaire. Obtaining as results that there is a relationship between the chain of custody and the crime of simple homicide; Likewise, there is a significant correlation between the chain of custody and qualified homicide; and there is a significant correlation between the chain of custody and injuries.

La calidad de los informes periciales en sus diversas modalidades de falsificación de firmas en el departamento de grafotecnia de la Policía Nacional del Perú, Lima 2022

The main objective of this research is to evaluate the quality of graphotechnical reports in the different modalities of signature forgery in the graphotechnical department of the National Police of Peru, Lima 2022. The methodology used had a qualitative approach with a phenomenological approach framework. The study scenario had a population of 19 graphophotechnical experts, from which six graphophotechnical experts were selected considering inclusion and exclusion criteria. The techniques used were conversation recordings and annotations. The results showed that the quality of the graphotechnical reports is guaranteed through the expert procedure governed by the criminalistics manual, using the graphoscopic method considering the analytical, comparative and conditional aspects with respect to the signatures, emphasizing also the due training and constant updates. To conclude, the entity lacks accreditation within the field of graphotechnics, the graphotechnical expert does not have certifications according to the ISO17024 standard, however, the specialists receive constant training and are governed by the procedures manual to carry out a quality scientific technical procedure based on the graphoscopic method indicated in the manual of criminalistics of the national police of Peru.

Características osteológicas macroscópicas para la determinación del taxón humano y del taxón mamífero cuadrúpedo no humano durante el análisis antropológico forense

Los restos óseos y dentales de animales y humanos son tejidos duros resistentes al paso del tiempo y son por lo tanto una valiosa fuente de información biológica y cultural. Ya sea que analicemos restos completos de fauna o restos humanos a nivel macroscópico la clasificación taxonómica puede ser hecha sin mayor problema usando para ello material osteológico documentado comparativo, manuales apropiados o confiando en la propia experiencia del investigador. Es usual encontrar en contextos arqueológicos y forenses restos humanos mezclados con restos animales relacionados en algunos casos a prácticas de consumo y en otros a prácticas criminales que tienen que ver con la desaparición de las evidencias. La diferencia de las formas y sus características morfológicas cualitativas entre huesos humanos y no humanos es el principal método para diferenciarlos. Todos los mamíferos incluidos el individuo humano tienen los mismos huesos con algunas adiciones y sustracciones. Sólo algunos huesos son propios de algunos animales como el hueso peneano (conocido también con los nombres de baculum, os penis y os priapi) y otros cuyo mayor desarrollo son propiamente humano como la clavícula. Las diferencias anatómicas más destacadas entre los humanos, de locomoción bípeda, y los mamíferos terrestres cuadrúpedos se observan principalmente en el cráneo, los miembros superiores (especialmente las manos), el complejo pélvico y los miembros inferiores (particularmente los pies). En esta última región, los huesos humanos son proporcionalmente más grandes debido a la adaptación al bipedalismo. Los resultados demuestran y concluyen que existen características anatómicas diferenciales a nivel macroscópico entre huesos humanos y no humanos siempre y cuando los elementos analizados se presenten completos o fragmentos que contengan características anatómicas diagnósticas.

Competencias profesionales y los informes de psicología forense del ministerio público en la región Cajamarca, 2021

The general objective of the thesis was to establish the relationship between professional skills and the development of forensic psychology reports of the Public Ministry in the Cajamarca Region, 2021, 2021. In this sense, forensic psychology reports in cases of family violence, may or may not become true instruments of a rigorous nature in judicial processes, since in many of them the psychological antecedents of the aggressor, as well as the real psychological injuries of the victim. The research has a quantitative approach, the level of research is descriptive correlational and the research design is non-experimental; The sample is a census, in suchs as way thats all the units of the population will be taken as a sample and it is made up of 60 forensic psychologists from the Public Ministry of the Cajamarca region. The questionnaire was used as an instrument, and the technique was the survey. The main result of the thesis is that the variable "professional skills" is moderately related to the variable "development of forensic psychology reports", since the Spearman correlation coefficient is 0.764, the null hypothesis is ruled out; There is a significant relationship between professional skills and the development of forensic psychology reports from the Public Ministry of the Cajamarca region.

Consumo de drogas y su relación con las infracciones cometidas por los adolescentes intervenidos por la PNP en la región Ayacucho 2019

The objective of this research was to “Determine the relationship between drug use and the offenses committed by adolescents intervened by the PNP in the Ayacucho region, 2019”, for which purpose, work was carried out under basic research with a high level correlational. The research was also based on a non-experimental design, with a longitudinal section. The sample was made up of 138 infractions committed by adolescents intervened by the Peruvian National Police of the Ayacucho Region during 2019. The instrument applied to collect the data was the document analysis guide generated from the indicators established for each of the variables. Thanks to this, it was concluded that: there is a significant relationship at the 0.026 level according to the Chi-square test between drug use and the offenses committed by adolescents operated by the PNP in the Ayacucho region, thanks to which, the general hypothesis was accepted. Furthermore, it was found that drug use is only related to the dimensions of infringements against heritage and offenses against sexual freedom.

Contaminación de la escena del crimen y la identificación dactilar de presuntos autores de homicidios en la jurisdicción policial, Lima Metropolitana-2024

In the world, Dactyloscopy is the Fingerprinting is the most effective technique and science for identifying people through the fingerprints on their fingers, because fingerprints are unique; there are no two people in the world with the same fingerprints, even if they are twins; in this sense, the present thesis aims to determine the relationship between crime scene contamination and fingerprint identification of alleged perpetrators of homicides in the police jurisdiction of Metropolitan Lima, given the skyrocketing crime rate and murders by contract killing, extortion, robbery, etc., due to the entry into the country of Venezuelan citizens with extensive criminal records. The research had a quantitative approach, basic type, non experimental design and correlational level, the population consisted of 108 experts and the sample by 85 experts from the DIRCRI-PNP, as a result, it was determined that 55% of the experts surveyed reported that when they arrived at the crime scene, many of them were found contaminated, on the contrary, 16% indicated that they found them in regular condition and 14% indicated that they found them in good condition of isolation and protection, which made it easier for them to find the means of proof to identify the alleged perpetrators of homicides and other crimes. It was concluded that there is a strong and high positive significant relationship, with a degree of correlation of .776 of Spearman's Rho, between the variables under study.

La criminalística y la prueba pericial en la etapa del juicio oral en el Poder Judicial de Lima, 2022

The objective of this work was to determine the existence of a relationship with respect to criminalistics and expert evidence in the stage of the oral trial in the Judicial Power of Lima, 2022. The methodology that has been used has been the inductive method, quantitative approach, applied type, non-experimental design, with a population of 100 and a sample of 90 police officers from the Central Special Services Unit - Lima Police Region; these were designated through purposive non-probabilistic sampling, the survey technique, the instrument used was the questionnaire, validation was performed through expert judgment, the reliability of Cronbach's alpha was 0.916 for criminalistics and 0.930 for expert evidence. The results of the statistics used were Spearman's Rho correlation ,341 (p=0.001 <0.05); concluded that the related existence is low statistically significant between the two variables.

Efecto de Aldicarb y Metamidofos en la tasa de desarrollo de Chrysomya Albiceps, Cochliomyia Macellaria e intervalo Postmortem

The importance of ghouls is known in the field of forensic investigations, since they are considered indicators of time of death or portmorten interval, however, there are factors that can influence them, such as the presence of certain toxins involved in the deaths either caused or accidental. In this sense, the objective of the present investigation was to determine the effects that the pesticides aldicarb and metamidifos exert on the biological development of two of the main species of forensic interest Chrysomya albiceps and Cochliomyia macellaria that are used for the evolution of the portmorten interval in the sciences. Forensics For this, three different doses 0.5LD50, LD50 and 2xLD50 of both toxic substances were inoculated in the food of these species. Post embryonic growth curves of Chrysomya albiceps and Cochliomyia macellaria were elaborated, based on length (mm), development time, taking into account the three doses of both pesticides; the rearing of both species was an average environmental temperature of 28.5 ºC, and an average relative humidity of 58.3%., which estimated the Postmortem interval (IPM). Based on the results of the present investigation, it can be concluded that the pesticides aldicarb and methamidophos inoculated at three different doses in their food (0.5LD50, LD50 and 2xLD50), influence the development rate of the two species Cochliomyia macellaria and Chrysomya albiceps, considered forensic indicators, this will inevitably influence the establishment of the Postmorten interval.

Evaluación de los informes periciales sobre dispositivos móviles para las investigaciones en los delitos de feminicidio en el distrito fiscal del Callao, 2023

The research aimed to understand how expert reports on digital analysis of mobile devices are prepared in femicide investigations in the Callao District Attorney's Office during 2023. A qualitative approach was applied, using an inductive method and a phenomenological design, with a sample of nine specialists. The data collection instrument was a semi-structured interview with 32 questions, and data analysis was performed using triangulation and hermeneutic analysis with Atlas.ti software. The results showed that expert reports on mobile devices are a key tool for proving the crime, provided they are prepared according to expert guidelines and manuals. The study also identified the need for experts to have professional training or specialization in the relevant area, demonstrating their technical competence. It was determined that a quality expert report must include positive extraction results, comply with the Code of Criminal Procedure and the Daubert criteria, and be defensible in court. Furthermore, it was concluded that digital forensics influences the classification of femicide cases by providing relevant information about the context and subjective element of the crime. Finally, the importance of experts substantiating their reports in court was emphasized, and recommendations were issued to strengthen digital forensic practice in femicide cases.

Evaluación de los informes técnico policiales en los delitos por accidentes de tránsito en el Callao, 2023

The main objective of this research work was to evaluate how police technical reports contribute to traffic accident crimes in Callao, 2023. The method used in this research was hermeneutical, with a qualitative approach, phenomenological design, taking as a sample to the population of 08 specialists to examine the reasoning and rigor of the respective examination of police technical reports on traffic accidents. On the other hand, 2 prosecutors, 2 police officers, 2 trial lawyers and 2 experts with experience in traffic cases were interviewed. The instrument was applied to them, this being an-interview; the Atlas Ti-Version 9 program was used for data analysis. Having carried out the analysis as results, it can be seen that to evaluate how police technical reports contribute to crimes due to traffic accidents in Callao, 2023, five important axes were identified: which are detailed below: 1. The transcription of the occurrence. 2. The analytical description. 3. The conclusions. 4. Traffic accidents in the crimes of injuries and manslaughter. Likewise, it was concluded that there are deficiencies and errors in the police technical reports that could trigger problems in the investigation and a criminal process not in accordance with current criminal regulations and the rules that govern our legal system, which would generate acquittals or convictions. wrong. It is also important to note that police technical reports are extremely relevant in determining the responsibility of the subject involved. Evaluar el procedimiento de levantamiento del cadáver en la escena del crimen por los médicos legistas de Apurímac, 2022

The main objective of this research work was to evaluate the procedure for the removal of the corpse at the crime scene by the forensic doctors of Apurímac during the year 2022", the method used in this investigation was hermeneutic, with a qualitative approach, design phenomenological, having as a sample the population of 4 medical examiners. The instrument was applied to them, this being an interview. For data analysis, the Atlas TiVersion 9 program was used. Once the analysis has been carried out as results, it can be seen that for the category evaluating the procedure for removing the corpse, 6 important axes can be identified: which are detailed below: 1.- The determination of the cause of death, which has various difficulties and the which the interviewees also give alternatives for improvement. 2.- The post mortem interval, which has its own difficulties and which also has recommendations for improvement. 3.- The examination of the area related to where the body was found, which may or may not be completed.4.- Adverse factors that make it difficult to remove the body from the crime scene.5.- The support provided by the institution for their staff to be trained, which in some cases is absent and, finally, 6.- The level of specialization that forensic experts have, which may be linked to the development of courses, second specialties or international internships. Likewise, we come to the conclusion that the process of removing the corpse will support in verifying the death, estimating the post mortem interval and likewise to determine the mechanism and way in which that death occurred, in the same way, during the procedure they will present adverse factors that will make the work a little heavier, but what with the experience of forensic doctors and respecting the appropriate protocols will contribute to providing relevant information regarding external, internal examinations, but it should be noted that the aforementioned will be achieved thanks to the training, new techniques, international internships and time of service that legal medical personnel must receive and carry out in order to carry out said functions for the benefit of the population that needs their work.

The present work about factors of labor harassment, labor harassment or mobbing and its influence on the right to integrity. It aims to describe the phenomenon, analyze its causes and consequences regarding the worker and the institution, as well as analyze the various theories that have tried to explain it from organizational, psychopathological and relational perspectives. In order to achieve the proposed objectives, an exhaustive bibliographical review of the national and international literature has been carried out, from the first investigations on the subject, observing that the studies deal fundamentally with the factors that determine the appearance of workplace harassment or workplace harassment, its consequences and the duty of organizations to adopt internal policies and measures to prevent and punish them. For the development of the investigation, two structured questionnaires based on previous instruments have been used as instruments, so that they address the factors that generate the hostilization appropriate to the Peruvian reality, which were applied to administrative workers of the central headquarters of the Public Ministry of the Fiscal District of Ica, with which it is intended to know the perception of the behaviors related to labor harassment, how often they feel affected by said phenomenon and finally to know what consequences in their physical or psychological integrity they have perceived.

Factores de riesgo que influyen en la calidad de la investigación en la escena del crimen del personal policial de las comisarías de Ayacucho, año 2021

The purpose of the investigation was to determine the risk factors that influence the quality of the crime scene investigation of the police personnel of the Ayacucho Police Stations. It was carried out under the quantitative approach, applied type, non-experimental design; the survey was used, which for the independent variable a value of 0.892 was found and for the dependent variable 0.961 was obtained, showing that there is a very high level of reliability for the results found, which observe that the human factor if significantly influences the quality of crime scene investigation (p-value= 0.001 < 0.05, CCRS= 0.367), technological factor (p-value= 0.008 < 0.05, CCRS= 0.295), environmental factor (p-value= 0.025 < 0.05, CCRS= 0.251) if they significantly influence the quality of crime scene investigation. It concludes that the risk factors do significantly influence the quality of the crime scene investigation (p-value= 0.000 < 0.05) and with a CCRS= 0.534, it shows that there is a considerable positive influence.

Influencia del dactilograma policial y la identificación de personas en cadáveres nomen nescio de la morgue de Huancayo, 2019 al 2021

In the investigation, dactyloscopy is not put into discussion as a method of identification and individualization of people, here what is considered as a sample element are police expertise. In them, the fulfillment of each of the fundamental moments of the dactylogram was evaluated, based on the fact that no type of blemishes or observations have been presented to the skills carried out in the VIII Dirtepol Junín, setting out the objective of the investigation; explain the influence of the police dactylogram in the identification of people in the nomen nescio corpses of the Huancayo morgue. Methodologically it is a thesis, analytical - deductive, quantitative approach, applied type, explanatory level and non-experimental design, transversal - retrospective, relational - explanatory, census sample of 56 expertise. Result and conclusion, Of the general objective, a p>0.05 and R2 of 31.8% to 60.2% establish that the null hypothesis is accepted: The police fingerprint does not influence the identification of people, of the corpses nomen nescio of the Huancayo morgue. Of the specific objectives that evaluate each of the fingerprint identification characters, specific objective 1 gives a p - value <0.05 and a percentage influence of 89.3%, establishing that: the first order (classification) character influences identification of people in corpses N.N. Of the specific objective 2, 3 and 4 give a p value >0.05 and an R2; 11.5% to 18.3%, 23.9% to 33.4%, 21.9% to 39.7%, respectively. Establishing that the subclassifying identification characters, infratype and characteristic points do not influence the identification of nomen nescio corpses from the Huancayo morgue, 2019 to 2021.

El informe pericial de autenticidad de firmas y su relación con delitos de falsificación de documentos en expedientes judiciales en la corte superior de Justicia de Lima, sede comerciales 2017-2019

The main objective of the investigation was to determine the relationship of the expert report on the authenticity of signatures with the crime of falsification of documents in judicial files in the Superior Court of Justice of Lima Commercial Headquarters, 2017-2019. Regarding the methodology, the study was quantitative, non-experimental, cross-sectional and correlational. Likewise, the sample consisted of 18 judicial records of crimes of falsification of documents in the Superior Court of Justice of Lima, in the period 2017-2019, to collect the information, the observation technique was used, for which two lists of collation or check and to answer the objectives and hypotheses, the Spearman's Rho correlation statistic was used. The results showed that the expert signature authenticity report is not significantly related to the crime of falsifying documents (p = 0.668, Rho = -0.108). In addition, the general characteristics (p = 0.353 5, Rho = -0.233), the samples under study (p = 0.556 5, Rho = 0.149), the graphotechnical analysis of signatures (p = 0.799 5, Rho = -0.064) and the final evaluations of the expert signature authenticity report (p = 0.269 5, Rho = 0.275), are not significantly related to the crime of falsification of documents In conclusion, the expert report on the authenticity of signatures is not significantly related to the crime of falsifying documents in judicial files of the Lima Superior Court of Justice, 2017-2019.

La investigación criminal y forense en los delitos de corrupción de funcionarios, distrito fiscal de Piura 2025

Este estudio tiene como objetivo general describir cómo es la investigación criminal y forense en los delitos de corrupción de funcionarios en el Distrito Fiscal de Piura, 2025. Los materiales utilizados fueron cincuenta referencias bibliográficas especializadas en la materia (tesis, libros, artículos de revista, manuales y páginas web), además del software ATLAS.ti 25 como herramienta central para el análisis de las entrevistas realizadas con la guía de entrevista, que fue el instrumento del estudio. Asimismo, se empleó un método inductivo, de tipo aplicado con diseño descriptivo y enfoque cualitativo. Además, la población está conformada por seis fiscales especializados, seleccionados mediante el criterio, muestreo por conveniencia. En esta misma línea, se optó por tres categorías claves para el correcto desarrollo del estudio: investigación criminal, investigación forense y corrupción de funcionario; estas se ven reflejadas en las diez preguntas recogidas en la guía de entrevista, utilizando como técnica las entrevistas presenciales grabadas; con una transcripción literal, codificación abierta, axial y selectiva a través de ATLAS.ti 25; garantizándose los aspectos éticos mediante consentimiento informado, confidencialidad y validación del instrumento. De la triangulación de los resultados y los estudios previos se concluyó que el pesquisa identifica la autoría principalmente en casos de flagrancia, la capacitación de peritos carece de continuidad y estandarización, y que las investigaciones criminales y forenses aportan pruebas verificables, aunque limitadas por déficit de recursos humanos y técnico.

Likewise, in terms of the sample, it was made up of 15 police officers specialized in criminalistics who belong to the Tumbes Criminalistics Office, added to 78 investigative police officers from DIVINCRI-Tumbes, as well as 09 Prosecutors who belong to the First Provincial Criminal Corporate Prosecutor's Office. of Tumbes, divided into three investigative offices, which have competence in femicide crimes, for which two questionnaires were applied to each group (police personnel and prosecutorial personnel) of the Likert-type polytomous scale, designed with specific indicators for each one. of the variables. By virtue of this, it has been concluded that there is a relationship between the police investigation and the fiscal investigation in femicide crimes, in the Judicial District of Tumbes 2018-2019, significant relationship 0.762 (Sig. = 0.61 < 0.80). According to Spearman's Rho correlation coefficient, accepting with this the general hypothesis based on the results obtained. Additionally, it was discovered that the tax investigation variable has a directly proportional relationship with the police investigation variable and its dimensions; methodological processes, criminal investigation specialization, police report quantitative analysis and scientific foundations.

Prácticas sacrificiales desde la perspectiva criminalística como comportamiento cultural en Huaca Pucllana, Lima – 2023

The main objective of this thesis is to analyze pre-Hispanic sacrificial practices from a criminal perspective as a manifestation of cultural behavior during the occupation of the Lima culture (450 - 650 AD) in the Huaca Pucllana - Lima archaeological site. The methodology used is a qualitative approach with an inductive method and an ethnographic and narrative design. For this, the archaeological site of Huaca Pucllana is used as a scenario with a convenience population of 92 individuals. The study of the patterns of human sacrifice practices and funeral customs developed by the elite of the Lima culture of Huaca Pucllana have allowed us to define recurring behaviors associated with mass political and architectural sacrifices, carried out in times of social stress, with extreme violence, highlighting the female role as sacrificial object as well as sacrificial agent. Our main conclusion is that pre-Hispanic sacrificial practices can be studied from a criminalistic perspective and have certain characteristics that allow us to affirm that they are part of a cultural behavior related to political renewal.

Procesamiento de la escena del crimen y su relación con la calidad de la investigación en delitos sexuales del Distrito Fiscal de Cajamarca, 2022

The purpose of this investigation was to determine to what extent the processing of the crime scene is related to the quality of the investigation in sexual crimes Fiscal District of Cajamarca, 2022. The quantitative approach was used, the type of research is applied. non-experimental design, the survey and two questionnaires developed by the researcher were used as instruments, the population was 70 prosecutors and 10 forensic doctors from the City of Cajamarca, the reliability of the instruments in terms of the independent variable was found to have a value of 0.80 and with respect to the dependent variable, a value of 0.824 was obtained, thus showing that there is a high level of reliability in the research results found, allowing us to observe that the processing of the crime scene is related to the quality of investigation into sexual crimes. Consequently, if the crime scene is damaged, the investigation of justice operators has limits due to lack of evidence, not having impartial results. Therefore, it is recommended that crime scene processing professionals work in groups to create prompt and timely strategies for crime scene processing, which will allow them to be developed in an effective, efficient and quality manner. It concludes that the processing of the crime scene is related to the quality of the investigation in sexual crimes, so there is a considerable relationship.
