Publicación Acceso abierto Análisis de huellas labiales de Renaud como método de identificación forense en estudiantes de una universidad privada año 2023(Universidad Privada Norbert Wiener, 2023-08-31) Mendoza Corbetto, Marco Antonio; Neyra Rivera, Carlos DavidThe purpose of this research work is to validate the analysis of Reanud lip prints as a forensic identification method in students of a private university in 2023, through a type of applied research, with a non-experimental design and with a quantitative approach; with a sample of 132 students, using the observation as a technique and as an instrument the cheiloscopic file validated by Carvajal and others (2014) It was found that the type B groove was the most prevalent, with an 83.3% prevalence, that the commissure of the dejected type was exhibited as the most frequent, presenting in 68.9% of the cases and that the thickness of the medium lip was the most predominant with 66.7% Also, it was shown that lip impressions are unique with Renaud's analysis and the cheiloscopic pattern was not repeated in any of the 132 students, this method being valid as a method of forensic identification of people.Publicación Acceso abierto Eficacia del peritaje del dosaje etílico en accidentes automovilísticos en hombres de 20-40 años en Lima, 2023(Universidad Privada Norbert Wiener, 2024-10-22) Canchari Pillaca, Judith Jhazmin; Neyra Rivera, Carlos DavidThe present research focused on determining the relationship between the effectiveness of ethanol dosage expertise and traffic accidents involving men aged 20-40 years in Lima, 2023. The methodology was hypothetico-deductive, with a non-experimental design, a census-type sample, a population of 100 justice operators, a quantitative approach, and data collected via questionnaires. The results revealed a relationship based on gender and years of service, with 4.0% holding a doctoral degree. The relationship between the legal requirements of ethanol dosage expertise and traffic accidents was 0.579, below the margin of error (1%). Additionally, the relationship between the technical-scientific requirements of ethanol dosage expertise and the value of traffic accidents was 0.236, with a bilateral significance (p-value) of 0.018, also below the allowed margin of error (5%), thus validating the second hypothesis. It was concluded that the technical-scientific requirements of ethanol dosage expertise have a directly proportional but low relationship with traffic accidents. Furthermore, there is a directly proportional and moderate relationship between traffic accidents and ethanol dosage expertise examinations. The respondents stated that ethanol dosage expertise related to traffic accidents often meets legal, technical-scientific, and expert requirements.Publicación Acceso abierto Investigación criminal como base del fortalecimiento de la investigación preparatoria en los operadores de justicia de la provincia de Coronel Portillo 2021(Universidad Privada Norbert Wiener, 2022-09-20) Vera Valcarcel, Jorge Ricardo; Neyra Rivera, Carlos DavidCriminal investigation employ Criminalistic Science as a method of resolution of criminal proceedings. The principal objective was to determine the relationship between the Criminal Investigation and the Preparatory Investigation in the criminal justice operators in the province of Coronel Portillo. About the research methodology, the investigator applied the logic of inquiry(quantitative), non-experimental and basic approach, choosing for such a correlational design. His interest is focused on explaining how the variables Criminal Investigation and Preparatory Investigation are related between each other. The population chosen was the number of prosecutors of the provincial and deputy prosecutor's offices, of the offices of the criminal prosecutor's offices, as well as the criminal defense lawyers of the province of Coronel Portillo. This population has been identified in 255 people altogether, prosecutors and lawyers with a sample of 95% equivalent to 204 people. The statistical graphs found show that 51.0% consider that the preparatory investigation carried out with a correct criminal investigation is strong as well as 50% maintain that the criminalistic strategy and the legal strategy are synonymous. In this regard, it has been concluded that a good criminal investigation strengthens the preparatory investigation, that is, there is a significant relationship between the criminal investigation and the preparatory investigation.Publicación Acceso abierto Muerte violenta por homicidio en población migrante necropsiada en la Morgue Central de Lima durante los años 2019 al 2022(Universidad Privada Norbert Wiener, 2024-07-08) Lizarzaburu Alfaro, William Andrés Augusto; Neyra Rivera, Carlos DavidThe Forensic Thanatology Unit of the Central Morgue of Lima has been performing autopsies on different individuals belonging to a migrant population in order to find evidence that can aid and clarify forensic investigations. They have been using various instruments such as the autopsy protocol, which contains all the information regarding the cause and manner of death of these individuals. Therefore, the main objective of this research was to determine how violent death by homicide is related to the migrant population autopsied at the Central Morgue of Lima during the years 2019 to 2022, using a deductive methodology, quantitative approach, and non experimental design, with a sample of 188 autopsy protocols belonging to migrant population. Once these data were obtained, it was analyzed using IBM SPSS STATICS software, version 20. Additionally, for hypothesis testing, the Rho Spearman test was used, derived from an analysis of Pearson's Chi-Square test; with results showing that 55.9% of analyzed autopsy protocols belong to young adults, furthermore, 90.4% of the cases belong to the male gender, and 71.8% of the total sample belongs to the Venezuelan population. The conclusion reached was that there is a relationship between violent deaths by homicide and the migrant population autopsied at the Central Morgue of Lima between the years 2019 to 2022 with 100% confidence.Publicación Acceso abierto La odorología forense y su aporte al desempeño funcional del Departamento de Policía Canina de la Policía Nacional del Perú. Lima 2017-2021(Universidad Privada Norbert Wiener, 2022-03-25) Montalvan Escobedo, César Augusto; Neyra Rivera, Carlos DavidThe general objective of the present investigation was to determine to what extent forensic odorology improves the functional performance of the Canine Police Department of the National Police of Peru, Lima 2017-2021. Considering a non-experimental method, with a quantitative approach, applied type, descriptive level, correlational and causal scope, crosssectional. The population consisted of 102 police officers from the Canine Police Department of the National Police of Peru; and the sample of 81 officials, who were selected considering inclusion and exclusion criteria, and through simple random sampling; The technique used was the survey and the instrument a self-elaborated questionnaire validated by expert judgment, and subjected to reliability with Cronbach's Alpha. After field work, results were obtained which were analyzed using SPSS software version 26.0. Finally, it was concluded that forensic odorology does significantly improve the functional performance of the Canine Police Department of the National Police of Peru, Lima 2017- 2021, whose support was based on the result obtained by the Spearman test (Rho = 0.743; Sig. = 0.000), being a medium positive correlation, in the same way it was demonstrated that the scientific, legal-legal, practical-social, and philosophical dimension of forensic odorology improves the functional performance of DEPOLCAN-PNP in Lima 2017-2021.Publicación Acceso abierto Pericias toxicológicas en delitos de violencia sexual en una entidad pública-Lima 2022: estudio cualitativo(Universidad Privada Norbert Wiener, 2023-08-11) Perez Vidalon, Katy Olga; Neyra Rivera, Carlos DavidThe purpose of the study was to analyze the perceptions of the experts on compliance with the toxicological expert procedures in crimes of sexual violence in a public entity - Lima 2022. The approach was qualitative, inductive method, phenomenological design; the sample consisted of 10 experts. From the area of toxicology, a semi-structured interview with 11 questions was applied; the analysis of the information was carried out by triangulation and hermeneutic analysis applying ATLAS. Ti 9. The results indicated that in the types of expertise, three significant aspects were found, improvements, determinants and the factors involved, highlighting time as an essential element, depression of the central system and substance use. The role of the expert turned out to be complex, focusing the responsibility on the preparation of reports based on the information, he receives and with the purpose of administering justice, preparation for oral trials, errors were evidenced by the police units. It was concluded that the expert procedures are fulfilled, the quantitative analysis, ethyl dosage is implemented more frequently; however, there are some limitations such as input, equipment and logistics, typing error, lack of personnel, technical report as a guarantee of information and justice, the sampling process.Publicación Acceso abierto El peritaje psicológico y las sentencias condenatorias de violación sexual en menores en el distrito judicial de Cañete 2019-2021(Universidad Privada Norbert Wiener, 2022-11-30) García Huanca, Luis Enrique; Neyra Rivera, Carlos DavidThe objective of this thesis is to determine the relationship that exists between the Psychological Expertise and the Convictions in minors aggrieved in the crimes of Sexual Rape in the Superior Court of Cañete between the years 2019-2021 and deals with the assessment of the Psychological Expertise in convictions of Sexual Violation of Minors in accordance with the provisions of Article 393, second paragraph of the Code of Criminal Procedure. The research approach is quantitative. They are subjected to a statistical analysis, being the type applied, an ex post facto design is also established. The population is 80 judicial files having a census sample, the technique used is the observation of documents, the instruments are also used as a record of data collection of judicial decisions, the processing and analysis is materialized through descriptive and inferential statistics. . Using a methodology corresponding to the hypothetical-deductive method, allowing the formulation of hypotheses based on existing theories, contrasting them with reality through specific data, and subjecting them to rigorous tests to validate preconceived ideas. With a quantitative approach whose value is sequential and probative; of an applied or practical nature. Additionally, a correlational level or scope was applied, indicating the degree of relationship between the variables of a studied population; using a non-experimental design and a non-probabilistic sampling that implies a selection based on the convenience of the author, whose population was 854 convicting sentences and 94 preparatory investigations as a sample. The technique used for this research was Documentary Analysis with a Data Capture Form instrument. Obtaining results, 98.94% of alcohol and 2.13% of cocaine present in cases of family aggression, it was identified that 100.00% of Physical Aggressions and 25.53% of Physical and Psychological Aggression are present in preparatory investigations for family violence cases. Lima. 2021(Universidad Privada Norbert Wiener, 2022-01-26) Montes Chamorro, Daniel Moises; Neyra Rivera, Carlos DavidThis research focused on determining the relationship of forensic toxicology in the ethyl alcohol dosage in the investigation of automobile accidents in charge of the National Police of Peru in the district of Huacho, in the city of Lima during the period 2021. The research methodology used corresponded to a hypothetical-deductive method, whose design was non-experimental in a study group, the sample consisted of 80 specialists from the Criminal Investigation Center and PNP health personnel, which is a census-type sample since the population is equal to the sample. In addition, the approach was quantitative because the data were analyzed statistically and respond to the objectives proposed in the research. The technique was the survey and the instrument used were two questionnaires that were validated through the judgment of experts dedicated to the area of study. Thus, these instruments evaluated the specialists at a single moment, in order to corroborate their knowledge of the research variables. Thus, according to the results obtained, it could be concluded that there is a weak positive correlation between the variables Forensic Toxicology and Ethyl Dose between the specialists of the Criminal Investigation Center and the PNP health personnel and it is also expressed that the significance level between both variables is greater than 0.05 (p>0.05).
