The problem has been diagnosed through an interview applied to judges of first and second instance of the family and mixed specialty of the Judicial District of Callao. It is worth mentioning that the present thesis is a qualitative, theorybased approach, with which it can establish causality. Also, documentaries consisting of files on civil interdiction resolved in the Mixed Transitory Chamber of Callao were analyzed to give consistency and prove the problem. Finally, the consequences of paragraph 1 of article 408 of the Civil Procedure Code, the comparative legislation of the Argentine Republic, Colombia and Brazil, all in order to verify the legal nature of these countries, their purpose in the ordering, were analyzed.
