La imperfección de la escena del crimen en accidentes de tránsito y su incidencia en la investigación de los operadores de justicia del distrito de Tarapoto, 2019

Abstract

El presente estudio de maestría tuvo como objetivo determinar la incidencia de la imperfección de la escena del crimen en accidentes de tránsito que influyen en la investigación de los operadores de justicia del distrito de Tarapoto, desarrollándose con base al personal de criminalística, los procedimientos y la protección de la escena del crimen. El tipo de investigación fue aplicado, con un enfoque cuantitativo de nivel descriptivo y diseño correlacional, no experimental y transversal. La población estuvo conformada por los 15 operadores de justicia del distrito de Tarapoto; la muestra se considera de tipo censal, no probabilística, donde la muestra fue igual a la población (n=N). Para el recojo de información se utilizó la técnica de la Encuesta y como instrumento el Cuestionario, elaborado para cada una de las variables en estudio; sendos instrumentos cuenta con validez de contenido y confiabilidad estadística mediante el alfa de Cronbach, obteniéndose valores de tendencia alta para ambos cuestionarios (c1= 0.736 y c2= 0.888). Los resultados de la investigación determinan que el nivel de la variable IMPERFECCIÓN de la escena del crimen en accidentes de tránsito se encuentra en un nivel medio y el nivel de la variable INVESTIGACIÓN de los operadores de justicia también es medio. También existe una correlación a nivel del 5%, es decir; es significativa, media, directa y positiva, determinado por el coeficiente de correlación de Pearson (r=0,533*) y un Sig. Bilateral de 0,041. Al obtener un Sig. (bilateral), cuyo valor es menor a 0.05 se acepta la hipótesis general (Hi), por lo tanto, si existe incidencia significativa entre la imperfección de la escena del crimen y la investigación de los operadores de justicia. Por ende, si la escena del crimen se ve contaminada, la investigación de los operadores de justicia se ve limitada o tiende a limitarse por falta de pruebas.

The purpose of this master's study was to determine the incidence of the crime scene imperfection in traffic accidents that influence the investigation of the justice operators of the Tarapoto district, being developed based on criminalistics personnel, procedures and Crime scene protection. The type of research was applied, with a quantitative approach of descriptive level and correlational, nonexperimental and transversal design. The population was conformed by the 15 operators of justice of the district of Tarapoto; The sample is considered census type, not probabilistic, where the sample was equal to the population (n = N). For the collection of information, the Survey technique was used and as an instrument the Questionnaire, prepared for each of the variables under study; Both instruments have content validity and statistical reliability through Cronbach's alpha, obtaining high trend values for both questionnaires (c1 = 0.736 and c2 = 0.888). The results of the investigation determine that the level of the IMPERFECTION variable of the crime scene in traffic accidents is at a medium level and the level of the INVESTIGATION variable of justice operators is also medium. There is also a correlation at the 5% level, that is; It is significant, medium, direct and positive, determined by Pearson's correlation coefficient (r = 0.533 *) and a Bilateral Sig of 0.041. When obtaining a Sig (bilateral), whose value is less than 0.05, the general hypothesis (Hi) is accepted, therefore, if there is a significant incidence between the imperfection of the crime scene and the investigation of the justice operators. Therefore, if the crime scene is contaminated, the investigation of the justice operators is limited or tends to be limited due to lack of evidence.
