Informe Jurídico sobre el Expediente Disciplinario N° 1699-2023 Lambayeque

Abstract

El presente informe jurídico analiza el procedimiento administrativo disciplinario seguido contra el servidor judicial Juan Manuel Cerna Rodríguez, tramitado por la Autoridad Nacional de Control del Poder Judicial (ANC-PJ) en el Expediente N.º 1699 2023-Lambayeque, con el propósito de determinar si la sanción de destitución impuesta, se ajustó a los principios de legalidad, motivación y proporcionalidad que rigen el Derecho Administrativo Disciplinario. La investigación, de enfoque cualitativo y analítico, se basó en la revisión de la normativa especial del Poder Judicial, la doctrina nacional y la jurisprudencia emitida por el Tribunal Constitucional y la Corte Interamericana de Derechos Humanos. Los resultados evidencian que la ANC-PJ aplicó normas generales como el Código de Ética de la Función Pública (Ley N.º 27815) en lugar de las normas especiales establecidas en el Reglamento Interno de Trabajadores del Poder Judicial (R.A. N.º 000099-2022-CE-PJ) y en el Reglamento Disciplinario de los Auxiliares Jurisdiccionales (R.A. N.º 227-2009-CE-PJ), de manera que vulneró el principio de especialidad normativa. Asimismo, el órgano revisor restringió su actuación a un control formal, afectando el debido procedimiento, y la sanción careció de pruebas directas suficientes, comprometiendo la presunción de inocencia. En conclusión, se advierte que las resoluciones emitidas no se ajustaron plenamente a derecho, por lo que se recomienda fortalecer la motivación reforzada, la valoración probatoria integral y la aplicación prioritaria de las normas especiales del Poder Judicial.

The present legal report analyzes the disciplinary administrative procedure followed against the judicial officer Juan Manuel Cerna Rodríguez, processed by the National Authority for Judicial Control (ANC-PJ) in Case No. 1699-2023-Lambayeque. The objective is to determine whether the dismissal sanction imposed was in accordance with the principles of legality, motivation, and proportionality governing Administrative Disciplinary Law. The investigation, of a qualitative and analytical approach, was based on the review of the special regulations of the Judiciary, national doctrine, and jurisprudence issued by the Constitutional Court and the Inter-American Court of Human Rights. The results show that the ANC-PJ applied general rules—such as the Code of Ethics for Public Service (Law No. 27815)—instead of the special rules established in the Internal Regulations of Judicial Workers (R.A. No. 000099-2022-CE-PJ) and the Disciplinary Regulations of Judicial Assistants (R.A. No. 227-2009-CE-PJ), violating the principle of normative specialty. Furthermore, the reviewing body limited its action to a formal control, affecting due process, and the sanction lacked sufficient direct evidence, undermining the presumption of innocence. In conclusion, it is noted that the resolutions issued were not fully in accordance with the law, and it is recommended to strengthen reinforced motivation, comprehensive evaluation of evidence, and the priority application of the special regulations of the Judiciary.
