Abuso de autoridad y autonomía de los funcionarios públicos en la municipalidad del Centro Poblado Puerto Yurinaki 2020-2022

Abstract

En el contexto en que la Municipalidad de C.P.P.Y. resuelve un contrato de concesión con la empresa Turismo Ítalo Peruano YAKOL SAC, y esta impugna la decisión mediante recurso de apelación, el mismo órgano municipal declaró infundado dicho recurso. Ante ello, el objetivo fue examinar los fundamentos jurídicos que permiten que la Municipalidad del C.P.P.Y. resuelva recursos de apelación en contratos de concesión de menor cuantía y analizar si ello resulta constitucional. La investigación tuvo enfoque dogmático, alcance descriptivo y método hermenéutico, aplicando razonamiento deductivo y análisis documental. Los resultados evidencian que las municipalidades de centros poblados no poseen autonomía política, económica y administrativa reconocida constitucionalmente. Se concluye que los fundamentos utilizados por la municipalidad no guardan concordancia con la Constitución ni con la ley, y que no resulta constitucional que el mismo órgano ejecutivo resuelva el recurso de apelación, pues vulnera el debido procedimiento y el principio de jerarquía administrativa.

In the context of the Municipality of C.P.P.Y. terminating a concession contract with the company Turismo Ítalo Peruano YAKOL SAC, and the company appealing the decision, the same municipal body declared the appeal unfounded. Therefore, the objective of this study was to examine the legal grounds that allow the Municipality of C.P.P.Y. to resolve appeals in concession contracts of lesser value and to analyze whether this is constitutional. The research employed a dogmatic approach, a descriptive scope, and a hermeneutical method, applying deductive reasoning and documentary analysis. The results demonstrate that municipalities in populated centers do not possess constitutionally recognized political, economic, and administrative autonomy. It is concluded that the grounds used by the municipality are not in accordance with the Constitution or the law, and that it is unconstitutional for the executive body itself to resolve the appeal, as this violates due process and the principle of administrative hierarchy.
