Informe Jurídico sobre el Expediente N° 20552-2016

Abstract

El presente informe jurídico se centra en el análisis del expediente judicial Nº 20552-2016, originado por la demanda de Tenencia y Custodia del menor D.J.P.C. interpuesta el 20 de octubre de 2016 por la Sra. J.E.C.U. contra el Sr. D.J.P.O. Ante el Organo Jurisdiccional Superior de Lima, experto en derecho familiar, la pretensión principal de la demandante era obtener el reconocimiento legal de su derecho a la tenencia y custodia de su hijo. En primera instancia, mediante la Resolución Nº 9, emitida el 18 de junio de 2019 por el 18º Juzgado Especializado de Lima, se falló a favor de la Sra. J.E.C.U., declarándose fundada su demanda. En consecuencia, se resolvió otorgarle la tenencia y custodia de su menor hijo, se estableció una determinación judicial del tiempo de interacción y comunicación en favor del padre y se instó a ambos progenitores a cumplir con lo dispuesto en la sentencia. Posteriormente, la Primera Sala Especializada de Familia de Lima, mediante Resolución Nº 4 de fecha 9 de julio de 2021, confirmó íntegramente la sentencia de primera instancia (Resolución Nº 9 del 18 de junio de 2019). De esta manera, se mantuvo la decisión de otorgar la tenencia y custodia del hijo a la madre y se ratificó la determinación judicial del tiempo de interacción y comunicación en favor del padre. A partir de lo actuado en este proceso judicial, el presente informe tiene como objetivo identificar y analizar los principales problemas jurídicos que se desprenden del caso, utilizando como base la normativa legal vigente y la doctrina jurídica aplicable.

This legal report focuses on the analysis of court file No. 20552-2016, originating from the custody and guardianship claim for the minor D.J.P.C. filed on October 20, 2016, by Ms. J.E.C.U. against Mr. D.J.P.O. Before the Superior Court of Lima, an expert in family law, the plaintiff's main claim was to obtain legal recognition of her right to custody and guardianship of her son. In the first instance, through Resolution No. 9, issued on June 18, 2019, by the 18th Specialized Court of Lima, the court ruled in favor of Ms. J.E.C.U., declaring her claim well-founded. Consequently, custody of their minor child was granted to the mother, a court-ordered visitation schedule was established in favor of the father, and both parents were ordered to comply with the provisions of the judgment. Subsequently, the First Specialized Family Court of Lima, through Resolution No. 4 dated July 9, 2021, fully upheld the first-instance judgment (Resolution No. 9 of June 18, 2019). Thus, the decision to grant custody of the child to the mother was maintained, and the court-ordered visitation schedule in favor of the father was ratified. Based on the proceedings in this judicial process, this report aims to identify and analyze the main legal issues arising from the case, using current legal regulations and applicable legal doctrine as a foundation.
