Chain of custody of indications and evidence in the crimes of simple homicide, qualified homicide and injuries in the fiscal district of El Tambo, 2022

Abstract

The present study had as general objective to determine the relationship that exists between the chain of custody of evidence and the crimes of simple homicide, qualified homicide and injuries in the fiscal district of El Tambo, 2022, based on the general problem: Is there a relationship between the chain of custody of indications and evidence and the crimes of simple homicide, qualified homicide and injuries in the fiscal district of El Tambo, 2022? For this reason, the understanding of how the chain of custody of indications and evidence was developed based on the experience of public servants and prosecutors of the Provincial Criminal Prosecutor's Office of Huancayo was developed and how it is related to crimes of simple homicide, qualified homicide and injuries. The present study had as methodological support the quantitative approach, of a basic or fundamental type, non-experimental design, whose population was made up of prosecutors from the Huancayo Provincial Criminal Prosecutor's Office and police officers who participate in the chain of custody process in crimes of homicide, abortion and injuries; The sample was made up of 80 professionals, including prosecutors and police officers; the technique used was the survey and the instrument was the questionnaire. Obtaining as results that there is a relationship between the chain of custody and the crime of simple homicide; Likewise, there is a significant correlation between the chain of custody and qualified homicide; and there is a significant correlation between the chain of custody and injuries.

El presente estudio tuvo como objetivo general determinar la relación que existe entre la cadena de custodia de indicios y los delitos de homicidio simple, homicidio calificado y lesiones en el distrito fiscal de El Tambo, 2022 esto a partir del problema general: ¿Existe relación entre la cadena de custodia de indicios y evidencias y los delitos de homicidio simple, homicidio calificado y lesiones en el distrito fiscal de El Tambo, 2022? Por esta razón se profundizó en la comprensión de cómo se desarrolló la cadena de custodia de indicios y evidencias a partir de la experiencia de servidores públicos y fiscales de la Fiscalía Provincial Penal de Huancayo y cómo se relaciona con delitos de homicidio simple, homicidio calificado y lesiones. La presente tuvo como soporte metodológico el enfoque cuantitativo, de tipo básico o fundamental, diseño no experimental, cuya población estuvo conformada por fiscales de la Fiscalía Provincial Penal de Huancayo y policías que participan del proceso de cadena de custodia en delitos de homicidio simple, homicidio calificado y lesiones; la muestra fue conformada por 80 profesionales entre fiscales y policías; la técnica utilizada fue la de la encuesta y el instrumento fue el cuestionario. Obteniendo como resultados que existe relación entre la cadena de custodia y el delito de homicidio simple; así mismo existe correlación significativa entre la cadena de custodia y homicidio calificado; y existe una significativa correlación entre la cadena de custodia y las lesiones.
