Informe Jurídico sobre Expediente Resolución N° 2969-2024-SUNARP-TR (INSIR-T)

Abstract

El objetivo de este informe jurídico es analizar el procedimiento administrativo registral que concluyó con la Resolución N° 2969-2024-SUNARP-TR (INSIR-T) emitida por el Tribunal Registral de la Superintendencia General de los Registros Públicos, encargado de resolver -en segunda y última instancia administrativa- los recursos de apelación interpuestos contra las decisiones de los registradores, tachas u observaciones. El proceso administrativo se inicia con la solicitud – declaración jurada – presentada por el solicitante ante el Registro de Predios de los Registros Públicos de Lima y Callao, ingresada con el Título 855212-2024 el 19 de marzo del 2024. En dicha solicitud se peticiona el levantamiento por caducidad de las hipotecas inscritas en los asientos 00007 y 00008 del Código de Predio P01018689, del Registro de Predios de Lima, amparándose en lo dispuesto en el artículo 3 de la Ley 26639 debido a que han transcurrido más de 18 y 16 años respectivamente desde su inscripción. Con fecha 08 de abril del 2024, la registradora publica encargada de la calificación observó el título presentado por adolecer de defecto subsanable; señalando que las hipotecas fueron constituidas para garantizar un crédito con acuerdo entre las partes de que se levantarían una vez cumplido el pago respectivo. Sin embargo, no consta una fecha expresa del vencimiento del crédito, lo que impide determinar el inicio del plazo de caducidad. El solicitante presentó recurso de reconsideración, argumentando que las hipotecas garantizan obligaciones futuras o eventuales sin un plazo definido, por lo que corresponde aplicar el artículo 3 de la Ley 26639. No obstante, la registradora reiteró su observación mediante pronunciamiento de fecha 30 de abril de 2024. Finalmente, el presentante interpuso recurso de apelación solicitando al Tribunal Registral, que revoque la observación y ordene la inscripción del título. Con fecha 12 de julio del 2024, el Tribunal Registral, mediante la Resolución N° 2969-2024-SUNARP TR (INSIR-T), resolvió revocar la observación del registrador público y dispuso la inscripción del levantamiento por caducidad de las hipotecas, previa verificación del pago de las tasas registrales correspondientes.

The objective of this legal report is to analyze the administrative registration procedure that concluded with Resolution No. 2969-2024-SUNARP-TR (INSIR-T) issued by the Registry Tribunal of the General Superintendency of Public Registries, responsible for resolving—in the second and final administrative instance—appeals filed against the decisions of registrars, objections, or observations. The administrative process begins with the application – sworn statement – submitted by the applicant to the Property Registry of the Public Registries of Lima and Callao, entered under Title 855212-2024 on March 19, 2024. In said application, the applicant requests the release due to expiration of the mortgages registered in entries 00007 and 00008 of Property Code P01018689, of the Lima Property Registry, based on the provisions of Article 3 of Law 26639 because more than 18 and 16 years, respectively, have elapsed since their registration.

On April 8, 2024, the public registrar in charge of the qualification observed the presented title due to a remediable defect; noting that the mortgages were established to guarantee a loan with an agreement between the parties that they would be released once the respective payment was made. However, there is no express maturity date for the loan, which prevents determining the start of the expiration period. The applicant filed a motion for reconsideration, arguing that the mortgages guarantee future or contingent obligations without a defined term, and therefore Article 3 of Law 26639 should apply. Nevertheless, the registrar reiterated her objection in a ruling dated April 30, 2024. Finally, the applicant filed an appeal requesting the Registry Court to overturn the objection and order the registration of the title. On July 12, 2024, the Registry Tribunal, through Resolution No. 2969-2024-SUNARP TR (INSIR-T), resolved to revoke the observation of the public registrar and ordered the registration of the release due to expiration of the mortgages, after verification of the payment of the corresponding registry fees.
