Abstract

El expediente 419-2022, el cual es iniciado por la demandante C.A.R.B., quien solicita la reposición del bien que es objeto de litigio en la demanda que realiza en contra de la demandada E.M.A.A. El bien inmueble deviene de una herencia, en ese momento la arrendadora era la madre de la hoy demandante y actual dueña de la propiedad hoy materia de Litis, la señora (C.R.B.C) administradora del hotel firma un contrato en la notaria con firmas legalizadas 01 agosto del 2015 finaliza el 31 de julio del 2016, el contrato era solo por un año sin opción a renovación ni plazo ampliatorio. Al termino del contrato la administradora del hotel, envió dos cartas notariales a la ahora demandada con fecha de 11 de febrero y 17 de febrero del 2020, desocupe y entregue el inmueble, a causa de que el acuerdo de arriendo ya había vencido. Con fecha 17 de enero de 2023, se emite la primera sentencia, por medio del cual se declara aceptada el proceso. La emplazada introduce procedimiento de apelación aduciendo que no existe un contrato vigente con la actual demandante si no con la madre y no se tiene la condición de precario. En la sentencia de vista se vuelve a confirmar la demanda y en efecto se ejecuta la reposición del bien y al hacer caso omiso se dispone el lanzamiento.

The defendant filed an appeal, arguing that there was no valid contract with the current plaintiff, but rather with the mother, and that the contract was not precarious. The court ruling again confirmed the claim and effectively executed the repossession of the property. The eviction was ordered by the defendant.
