El derecho a vivir en un medio ambiente sano en zonas extractivas a luz del caso la Oroya vs Perú, 2024

Abstract

El actual trabajo de investigación titulado El derecho a vivir en un medio ambiente sano en zonas extractivas a luz del caso la Oroya vs Perú tiene como Objetivo determinar como la falta de control en las zonas extractivas afecta el derecho a vivir en un medio ambiente sano, caso la Oroya vs Perú 2024. La metodología en la presente investigación será un nivel descriptivo correlacional, con un enfoque cualitativo de diseño dogmático; donde se realizará el análisis documental. En la presente investigación se utilizaron instrumentos como la ficha de análisis documental, recayendo dicho análisis a sentencias sobre el tema plasmado, permitiendo al investigador arribar a la conclusión que existe una relación directa entre las categorías el derecho a vivir en un medio ambiente sano y zonas extractivas, asimismo, concluyendo que de acuerdo a toda la información recaudada, tanto en los resultados como en el porte temático se denota la existencia de una grave vulneración y afectación por parte del desarrollo de actividades en zonas extractivas; muchas veces de gran magnitud e impacto cuando propiamente el estado no ejerce un debido control y fiscalización; atentando así contra la seguridad jurídica de derechos fundamentales constitucionalmente protegidos; recomendando, fortalecer las herramientas de control, supervisión y fiscalización que permitan la adecuada aplicación de la normativa que regula la protección del medio ambiente y el desarrollo de actividades de extracción en zonas extractivas, sin perjuicio a la generación de nuevas regulaciones, con la finalidad de permitir, al estado y operadores de justicia un adecuado desarrollo de sus funciones, actuando con eficacia y eficiencia en el control frente a amenazas y futuras vulneraciones, así como el establecer responsabilidad de daños que puedan causarse el medio ambiente que transgredan derechos fundamental y contravengan el desarrollo sostenible.

The current research work entitled The right to live in a healthy environment in extractive areas in light of the La Oroya vs. Peru case aims to determine how the lack of control in extractive areas affects the right to live in a healthy environment, La Oroya vs. Peru case 2024. The methodology in this research will be a descriptive correlational level, with a qualitative approach of dogmatic design; where the documentary analysis will be carried out. In this research, instruments such as the documentary analysis sheet were used, with said analysis falling on sentences on the subject expressed, allowing the researcher to reach the conclusion that there is a direct relationship between the categories of the right to live in a healthy environment and extractive areas, also concluding that according to all the information collected, both in the results and in the thematic scope, the existence of a serious violation and affectation by the development of activities in extractive areas is denoted; often of great magnitude and impact when the state itself does not exercise due control and supervision; thus undermining the legal security of constitutionally protected fundamental rights; recommending strengthening the tools of control, supervision and oversight that allow the proper application of the regulations that govern environmental protection and the development of extraction activities in extractive areas, without prejudice to the generation of new regulations, in order to allow the state and justice operators to properly develop their functions, acting effectively and efficiently in control against threats and future violations, as well as establishing liability for damages that may be caused to the environment that violate fundamental rights and contravene sustainable development.
