Informe Jurídico sobre el Expediente N.º 2002-00119-222206JP01-SPOJ

Abstract

El presente análisis jurídico tiene como finalidad estudiar el expediente penal N.º 2002 00119-222206JP01-SPOJ, tramitado ante el Juzgado Penal de Mariscal Cáceres, originado por la denuncia de la persona de iniciales T.P.P., contra S.M.R., por haber agredido sexualmente a su hija C.D.L.M.P. de 12 años de edad. Hemos advertido dos cuestionamientos relevantes: El primero: ¿Es necesario que la agraviada del delito de violación sexual precise el número exacto de veces que fue violentada sexualmente? El segundo: ¿La exigencia de que una menor de edad, víctima de violación sexual, declare hasta en cuatro oportunidades en un proceso penal, vulnere el deber estatal de evitar su revictimización? Concluimos que en nuestro marco normativo no se requiere que una víctima precise la cantidad de episodios de agresiones para la configuración del delito. Asimismo, corresponde al Estado proteger y garantizar los derechos de las personas agraviadas, evitando la exigencia de diligencias reiteradas que puedan generar su revictimización.

The purpose of this legal analysis is to study criminal case file No. 2002 00119-222206JP01-SPOJ, processed before the Criminal Court of Mariscal Cáceres, originating from the complaint filed by the person with the initials T.P.P., against S.M.R., for having sexually assaulted her 12-year-old daughter, C.D.L.M.P.

We have identified two relevant questions: First: Is it necessary for the victim of the crime of sexual assault to specify the exact number of times she was sexually assaulted? Second: Does requiring a minor, a victim of sexual assault, to testify up to four times in a criminal proceeding violate the state's duty to prevent her revictimization? We conclude that our legal framework does not require a victim to specify the number of assault incidents for the crime to be established. Furthermore, it is the State's responsibility to protect and guarantee the rights of victims, avoiding the requirement of repeated procedures that could lead to their revictimization.
