Eficacia de la prisión preventiva en el proceso penal dentro del distrito judicial de Cajamarca

Abstract

Para dictar prisión preventiva se debe considerar su carácter excepcional dentro del proceso penal. En ese sentido, ¿El control de legalidad que ejerce la Corte Suprema a través del recurso de Casación, evidencia que la aplicación de la prisión preventiva en el Distrito Judicial de Cajamarca garantiza el principio de excepcionalidad?, por ello, el objetivo general de la investigación fue determinar si la prisión preventiva se aplica realmente como una medida excepcional en el Distrito Judicial de Cajamarca. La investigación presenta una metodología de enfoque dogmático, alcance descriptivo y de tipo deductivo. Asimismo, se empleó como técnica de investigación el análisis documental, mediante el fichaje bibliográfico, así como la recopilación, selección y análisis de casaciones emitidas por la Corte Suprema, correspondientes a casos concretos ocurridos en Cajamarca y en otros distritos judiciales. Como resultado se obtuvo que el control de legalidad sí garantiza el principio de excepcionalidad en el plano jurisprudencial, pero al mismo tiempo revela que su aplicación en instancias inferiores presenta inconsistencias que requieren revisión y corrección por la Corte Suprema. Llegando a concluir que el control de legalidad desarrollado por la Corte Suprema mediante el recurso de casación permite advertir que la prisión preventiva en el Distrito Judicial de Cajamarca se ajusta al principio de excepcionalidad en el plano normativo; sin embargo, su aplicación en las instancias inferiores no siempre respeta este estándar, siendo necesaria la intervención del máximo órgano jurisdiccional para corregir decisiones deficientes.

To order pretrial detention, its exceptional nature within the criminal process must be considered. In this sense, does the Supreme Court's review of legality through the appeal process demonstrate that the application of pretrial detention in the Judicial District of Cajamarca guarantees the principle of exceptionality? Therefore, the general objective of this research was to determine whether pretrial detention is truly applied as an exceptional measure in the Judicial District of Cajamarca. The research employs a dogmatic, descriptive, and deductive methodology. Documentary analysis was used as a research technique, through bibliographic research, as well as the compilation, selection, and analysis of Supreme Court rulings in specific cases that occurred in Cajamarca and other judicial districts. The results show that the review of legality does guarantee the principle of exceptionality at the jurisprudential level, but at the same time, it reveals inconsistencies in its application at lower court levels that require review and correction by the Supreme Court. The conclusion reached is that the Supreme Court's review of legality through the appeal process reveals that pretrial detention in the Cajamarca Judicial District adheres to the principle of exceptionality at the normative level. However, its application in lower courts does not always respect this standard, necessitating the intervention of the highest court to correct deficient decisions. Nevertheless, full compliance with the principle of exceptionality is not evident, primarily due to the limited publication of appeals on this matter on the Supreme Court's institutional website, which restricts a broader and more transparent analysis of its application.
