Implicancias jurídicas del tercero adquiriente de buena fe, cuando existe un cambio de titularidad de prescripción adquisitiva

Abstract

La investigación tiene como finalidad analizar las consecuencias jurídicas que se generan cuando una prescripción adquisitiva de dominio, declarada judicialmente pero no inscrita, entra en conflicto con los derechos de un tercero registral que actúa de buena fe. Esta situación produce una doble titularidad sobre un mismo inmueble y abre un debate jurídico respecto a qué derecho debe prevalecer: el adquirido por el usucapiente o el protegido por la fe pública registral. El estudio se desarrolló bajo un enfoque cualitativo, de carácter básico y con diseño no experimental, utilizando como técnicas principales la revisión documental, el análisis jurisprudencial y entrevistas a especialistas en derecho civil y registral. Los resultados evidenciaron que, en la práctica, la protección legal suele favorecer al tercero que confía en el registro, aunque ello genere tensiones frente al derecho previamente adquirido por prescripción. Asimismo, se identificó que la falta de uniformidad en la jurisprudencia y la ausencia de criterios claros sobre la buena fe ocasionan inseguridad jurídica en el tráfico inmobiliario. Finalmente, se concluye que resulta necesario fortalecer la interpretación normativa y la coherencia jurisprudencial para garantizar un equilibrio entre la protección de los terceros registrales y el reconocimiento efectivo de los derechos derivados de la prescripción adquisitiva.

This research aims to analyze the legal consequences that arise when an acquisitive prescription of ownership, judicially declared but not registered, collides with the rights of a good faith third party who relies on the public registry. Such cases create a double ownership over the same property and raise a legal debate on which right should prevail: the one acquired by the usucapient or the one protected by public registry faith. The study followed a qualitative approach, with a basic and non-experimental design, employing documentary review, case law analysis, and interviews with specialists in civil and registry law. The findings show that, in practice, legal protection usually favors the third party who trusts in the registry, although this generates tensions with the right previously acquired through prescription. It was also identified that the lack of uniformity in case law and the absence of clear criteria regarding good faith create legal uncertainty in real estate transactions. In conclusion, the study highlights the need to strengthen legal interpretation and judicial consistency to ensure a fair balance between protecting good-faith third parties and effectively recognizing rights derived from acquisitive prescription.
