Contextualización socio-médico-legal de las mujeres recluidas con niños en dos establecimientos penitenciarios de Lima, 2020: estudio mixto

Abstract

Objetivo: Construir un modelo teórico que permita contextualizar y comprender la situación socio-médico-legal de las mujeres recluidas con niños en dos establecimientos penitenciarios de Lima, 2020. Materiales y métodos: El estudio cuanti-cualitativo, diseño no experimental, explicativo-secuencial. Se aplicó la ficha de recolección de datos para la fase cuantitativa y la guía de entrevistas en profundidad para la fase cualitativa. La muestra de la fase cualitativa (n=13) representó un subconjunto de la población-muestra de la fase cuantitativa (n=58). Se calcularon las frecuencias absolutas y relativas de las variables cuantitativas, los datos cualitativos fueron sometidos a la codificación axial y el análisis de contraste de datos. Metainferencias de ambos análisis constituyeron el producto final del estudio. Resultados: La situación socio-médico-legal se caracterizó por diversas experiencias mayormente negativas, relacionadas con diferentes aspectos individuales y las condiciones de reclusión y tratamiento penitenciario. Se destacan graves deficiencias percibidas en la atención de salud de las internas y niños con énfasis en el maltrato e indiferencia por parte del personal. Se identificaron otros factores intervinientes en el contexto vivencial estudiado. Conclusión: Los resultados aportan evidencia sobre graves deficiencias estructurales y organizacionales que vulneran los derechos fundamentales del grupo poblacional estudiado. Los esfuerzos gubernamentales realizados hasta la fecha son parciales e insuficientes. Urgen políticas y programas sostenibles que prioricen la atención de salud de calidad y tratamiento penitenciario adecuado de dichas personas con énfasis en acciones preventivo-promocionales. Existe la necesidad de intervenciones basadas en evidencia que permitan reducir el efecto nocivo del encarcelamiento en la infancia.

Objectives: Build a theoretical model that allows contextualizing and understanding the social, medical and legal situation of women confined with children in two prisons in Lima, 2020. Materials and methods: The quantitative-qualitative study, non-experimental design, sequential explanatory. The data collection form for the quantitative phase and the in-depth interview guide for the qualitative phase were applied. The sample from the qualitative phase (n = 13) represented a subset of the population-sample from the quantitative phase (n = 58). The absolute and relative frequencies of the quantitative variables were calculated, the qualitative data were subjected to axial coding and contrast analysis of data. Meta-inferences from both analyzes constituted the final product of the study. Results: The social, medical and legal situation was characterized by various mostly negative experiences, related to different individual aspects and the conditions of confinement and prison treatment. Serious deficiencies perceived in the health care of inmates and children stand out, with emphasis on mistreatment and indifference on the part of the staff. Other intervening factors were identified in the experiential context studied. Conclusion: The results provide evidence of serious structural and organizational deficiencies that violate the fundamental rights of the population group studied. Government efforts to date are partial and insufficient. Sustainable policies and programs are urgently needed that prioritize quality health care and adequate prison treatment for these people with an emphasis on preventive-promotional actions. There is a need for evidence-based interventions to reduce the harmful effect of childhood incarceration.
