Abstract

En el presente estudio de análisis jurídico se examina el recurso de apelación interpuesto por el postor WILTOR S.A.C contra la resolución que otorga la buena pro al Consorcio Vallejo conformado por las empresas IVAL CONTRATISTAS E.I.R.L. y FVC INGENIERIA & CONSTRUCCION E.I.R.L. en el procedimiento de selección de la Adjudicación Simplificada N° 03-2024-MDA/CS-1, para la contratación de la ejecución de la obra Construcción de Cerco Perimétrico en la I.E. 82081 del Centro Poblado Cesar Vallejo - Distrito de Agallpampa - Provincia Otuzco - Departamento de la Libertad, recurso seguido en el Expediente N° 10969/2024.TCE, visto por la Quinta Sala del Tribunal de Contrataciones del Estado. Dicho recurso fue absuelto por la Representante Común del Consorcio Vallejo adjudicada con la buena pro quien argumentó que la pretensión del impugnante resulta sin sustento, debiendo ser declarada infundada y conservando la adjudicación de la buena pro a favor de su representada. Asimismo, mediante Informe Técnico Legal N° 418-2024- OGAJ/MDA, la Oficina General de Asesoría Jurídica de la Municipalidad Distrital de Agallpampa, fundamentó la posición de la entidad; concluyendo que el postor impugnante no tiene sustento legal, pues no se evidencia que el comité haya evaluado incorrectamente la oferta del postor adjudicado con la buena pro y que el Tribunal de Contrataciones del Estado deberá confirmar la decisión tomada por el comité de selección y declarar infundada las pretensiones interpuestas por el postor impugnante. Finalmente, mediante resolución N°04612-2024-TCE-S5 de fecha 19 de noviembre de 2024, la Quinta Sala del Tribunal de Contrataciones del Estado resuelve declarar infundado el recurso de apelación interpuesto por el postor WILTOR S.A.C y ordena confirmar la buena pro de la Adjudicación Simplificada N° 03-2024-MDA/CS-1, otorgada al postor adjudicado Consorcio Vallejo conformado por las empresas IVAL CONTRATISTAS E.I.R.L. y FVC INGENIERIA & CONSTRUCCION E.I.R.L, quedando agotada la vía administrativa. Visto lo actuado, se identificará y analizará los principales puntos controvertidos del caso en concreto, conforme a la normativa actualizada y a la doctrina.

This legal analysis examines the appeal filed by the bidder WILTOR S.A.C. against the resolution awarding the contract to the Vallejo Consortium, comprised of the companies IVAL CONTRATISTAS E.I.R.L. and FVC INGENIERIA & CONSTRUCCION E.I.R.L., in the Simplified Bidding process No. 03-2024-MDA/CS-1, for the construction of a perimeter fence at the I.E. 82081 school in the Cesar Vallejo settlement, Agallpampa District, Otuzco Province, La Libertad Department. This appeal was filed under Case No. 10969/2024.TCE and reviewed by the Fifth Chamber of the State Procurement Tribunal. The appeal was dismissed by the Common Representative of the Vallejo Consortium, the winning bidder, who argued that the appellant's claim was unfounded and should be declared unfounded, thus upholding the award of the contract to her consortium. Furthermore, through Technical Legal Report No. 418-2024-OGAJ/MDA, the General Office of Legal Counsel of the District Municipality of Agallpampa substantiated the entity's position, concluding that the appellant's claim lacked legal grounds, as there was no evidence that the committee had incorrectly evaluated the bid of the winning bidder. The report concluded that the State Procurement Tribunal should confirm the decision made by the selection committee and declare the appellant's claims unfounded. Finally, by Resolution No. 04612-2024-TCE-S5 dated November 19, 2024, the Fifth Chamber of the State Procurement Tribunal resolved to declare unfounded the appeal filed by the bidder WILTOR S.A.C. and ordered the confirmation of the award of Simplified Bidding No. 03-2024-MDA/CS-1 to the winning bidder, Consorcio Vallejo, comprised of the companies IVAL CONTRATISTAS E.I.R.L. and FVC INGENIERIA & CONSTRUCCION E.I.R.L., thus exhausting all administrative remedies. Having reviewed the proceedings, the main points of contention in this specific case will be identified and analyzed, in accordance with current regulations and legal doctrine.
