La pensión de alimentos frente a la afectación del interés superior del niño en el juzgado de paz letrado Lima Norte, 2024 (Expediente 04591-2020-0-0904-JP-FC-02)

Abstract

Introducción: Debo señalar que la investigación del caso está centrada en la falta de asistencia alimentaria que afecta al interés superior del niño, en una sociedad donde los padres no deciden pasar la pensión de alimentos de manera facultativa; el objetivo de la investigación es analizar la asignación de alimento y su afectación al interés superior. asimismo la metodología aplicada al estudio es de enfoque naturalista basado en la agudeza y diseño de fenómenos sociales con enfoque cualitativa, centrada en la interpretación; los resultados del estudio determina la aplicación y retribución alimentaria en relación al interés superior del niño permitiéndonos observar si realmente se aplica la normativa para el interés del niño; por lo tanto debemos concluir enfatizando en analizar y determinar la asignación de alimento y la afectación al interés superior, siendo lo más importante que el derecho del niño no es cautelada, siendo éstos generalmente vulneradas desde el seno familiar con la complicidad de falta de celeridad en los procesos.

ntroduction: I must point out that the investigation of the case is focused on the lack of food assistance that affects the best interest of the child, in a society where parents do not decide to pay child support in an optional manner; the objective of the research is to analyze the allocation of food and its impact on the best interest. Likewise, the methodology applied to the study is a naturalistic approach based on the sharpness and design of social phenomena with a qualitative approach, focused on interpretation; the results of the study determine the application and payment of food in relation to the best interest of the child, allowing us to observe whether the regulations are really applied for the best interest of the child; therefore, we must conclude by emphasizing the analysis and determination of the allocation of food and the impact on the best interest, the most important being that the right of the child is not safeguarded, these being generally violated from within the family with the complicity of lack of speed in the processes.
