Eficacia del decreto legislativo 1386 en la prevención de la revictimización institucional de mujeres víctimas de violencia familiar en el Callao, 2019-2024

Abstract

La investigación se desarrolló bajo un enfoque cualitativo de tipo descriptivo interpretativo, orientado a analizar la efectividad jurídica y social de las medidas de protección dictadas por el Estado frente a la violencia contra la mujer. El estudio se sustentó en análisis documental, revisión normativa y entrevistas semiestructuradas a operadores del sistema de justicia, con el fin de comprender las prácticas institucionales que inciden en la revictimización durante los procesos judiciales. Se aplicó el método hermenéutico y analítico-jurídico, que permitió interpretar los principios de protección integral, dignidad y tutela efectiva consagrados en la Ley N. º 30364 y el D. Leg. N. º 1386. Los hallazgos revelan que, si bien el marco normativo garantiza la protección de las víctimas, su aplicación resulta limitada por la escasa sensibilización de los operadores de justicia y la débil coordinación institucional, lo que genera revictimización. Se concluye que la eficacia de las medidas de protección depende del compromiso ético y del enfoque humano con que el Estado las ejecute.

The research, titled was conducted using a qualitative, descriptive-interpretative approach, aimed at analyzing the legal and social effectiveness of protective measures issued by the State against violence against women. The study was based on documentary analysis, regulatory review, and semi-structured interviews with justice system officials, aimed at understanding the institutional practices that influence re-victimization during judicial proceedings. The hermeneutic and analytical-legal method was applied, allowing for the interpretation of the principles of comprehensive protection, dignity, and effective protection enshrined in Law N°. 30364 and Legislative Decree N°. 1386. The findings reveal that, although the regulatory framework guarantees the protection of victims, its implementation is limited by the lack of awareness among justice officials and weak institutional coordination, which leads to revictimization. It is concluded that the effectiveness of protection measures depends on the ethical commitment and humane approach with which the State implements them.
