La ley general de Comunidades Campesinas y el derecho a la propiedad individual, en comuneros de Santiago – Santa Rosa, 2023

Abstract

Para el presente trabajo de investigación, realizado con el objetivo de determinar la percepción de los comuneros de la ley general de las comunidades campesinas respecto al acceso a la propiedad individual de las tierras familiares con riego en la comunidad de Santiago Santa Rosa del distrito de Chapimarca departamento de Apurímac, 2023. Se aplicó el método hipotético deductivo, enfoque cuantitativo, diseño descriptivo de tipo observacional transaccional, ya que el estudio se realizó en un solo momento y no se manipuló las variables porque los hechos ya ocurrieron, es una investigación básica. Se aplicó el cuestionario a la muestra representativa compuesta por 80 comuneros de Santiago Santa Rosa. Entre los resultados sobresalientes que se encontraron los comuneros perciben las tierras de vivienda o agricultura con riego deben ser de propiedad individual de cada comunero calificado, asimismo sugieren que deben ser tituladas para darles mayor seguridad jurídica. También consideran que el régimen de propiedad colectiva tipificada en la Ley N° 24656, Ley General de Comunidades Campesinas (en adelante la Ley 24656) debe ser reemplazada por mixta en el que los terrenos de vivienda y agricultura con riego deben ser de propiedad individual, mientras que los terrenos de secano y pastoreo deben seguir siendo de propiedad colectiva de la comunidad. En cuanto a los atributos de la propiedad señalan que solo se cumple el de uso y goce; por lo tanto demandan acceder a la libre disposición y reivindicación de las tierras con riego que poseen. Finalmente están de acuerdo con la modificatoria de la Ley 24656.

For the present research work, carried out with the objective of determining the perception of the community members of the general law of the peasant communities regarding access to individual ownership of family lands with irrigation in the community of Santiago Santa Rosa in the district of Chapimarca department of Apurímac 2023, the hypothetical deductive method, quantitative approach, descriptive transactional observational design was applied, since the study was carried out in a single moment and the variables were not manipulated because the events already occurred, it is a basic investigation. The questionnaire was applied to the representative sample made up of 80 community members from Santiago Santa Rosa. Among the outstanding results that were found, the community members perceive that housing or agricultural land with irrigation should be individually owned by each qualified community member, and they also suggest that they should be titled to give them greater legal security. They also consider that the collective property regime typified in the general law of peasant communities should be replaced by a mixed one in which housing and agricultural land with irrigation should be individually owned, while dryland and grazing land should continue to be owned. collective property of the community. Regarding the attributes of the property, they point out that only the attribute of use and enjoyment is met; Therefore, they demand access to the free disposal and claim of the irrigated lands they own. Finally, they agree with the modification of the general law of peasant communities.
