Pericia de necropsia psicológica como herramienta en el código procesal penal peruano para muertes dudosas en Ventanilla, 2024

Abstract

Esta investigación examina la implementación de la necropsia psicológica como una herramienta útil dentro del Código Procesal Penal, con el propósito de esclarecer casos de muertes dudosas en Ventanilla durante el año 2024. Su principal finalidad es determinar de qué manera la implementación de esta técnica forense puede optimizar las investigaciones en fallecimientos de causa incierta, tales como suicidios, homicidios y feminicidios. Se adoptó un enfoque cualitativo, el cual incluyó entrevistas dirigidas a fiscales especializados en derecho penal, además de una revisión documental y el análisis de antecedentes internacionales. La selección de los participantes se realizó de forma intencional y no probabilística, con el propósito de conocer el nivel de familiaridad y aceptación de esta técnica en el sistema judicial peruano. Los resultados evidencian que los fiscales penales del Distrito Fiscal de Ventanilla tienen un conocimiento limitado sobre la necropsia psicológica. No obstante, reconocen que su incorporación podría ser útil para la recopilación de pruebas en investigaciones de muertes dudosas. Además, manifestaron interés en recibir formación para aplicar correctamente esta metodología. El estudio concluye que la formalización de la necropsia psicológica como prueba documental en el Código Procesal Penal contribuiría significativamente a la resolución de muertes de origen incierto, aunado a ello también tendría un impacto preventivo. Como recomendación, se sugiere desarrollar protocolos estandarizados y ofrecer capacitación a fiscales con el fin de garantizar su adecuada implementación en el sistema de justicia.

This research examines the implementation of psychological autopsy as a useful tool within the Criminal Procedure Code, with the aim of clarifying cases of uncertain deaths in Ventanilla during the year 2024. Its main objective is to determine how the implementation of this forensic technique can optimize investigations into deaths of uncertain cause, such as suicides, homicides, and femicides. A qualitative approach was adopted, which included interviews with prosecutors specializing in criminal law, in addition to a documentary review and analysis of international precedents. Participants were selected intentionally and non probabilistically, with the aim of determining the level of familiarity and acceptance of this technique in the Peruvian judicial system. The results show that criminal prosecutors in the Ventanilla District Attorney's Office have limited knowledge of psychological autopsy. However, they recognize that its incorporation could be useful for gathering evidence in investigations of uncertain deaths. Furthermore, they expressed interest in receiving training to correctly apply this methodology. The study concludes that formalizing psychological autopsies as documentary evidence in the Code of Criminal Procedure would significantly contribute to the resolution of deaths of uncertain origin, and would also have a preventive impact. It is recommended that standardized protocols be developed and training offered to prosecutors to ensure their proper implementation in the justice system.
