La investigación policial y su relación con la investigación fiscal en delitos de feminicidio en el distrito judicial de Tumbes 2018-2019

Abstract

El objetivo principal de la investigación es determinar en qué medida la investigación policial se relaciona con la investigación fiscal en los delitos de feminicidio, en el Distrito Fiscal de Tumbes. En lo referido a la metodología, el estudio es cuantitativo, hipotético deductivo, básica, no experimental, descriptiva correlacional. Asimismo en cuanto a la muestra estuvo conformada por 15 efectivos policiales especializados en criminalística que pertenecen a la Oficina de Criminalística de Tumbes, sumado a 78 efectivos policiales investigadores de la DIVINCRI-Tumbes, así como 09 Fiscales que pertenecen a la Primera Fiscalía Provincial Penal Corporativa de Tumbes, divididos en tres despachos de investigación, que tienen competencia en delitos de feminicidio, por lo que se elaboraron dos cuestionarios aplicados a cada grupo (personal policial y personal fiscal) de la escala politómica tipo Likert, diseñado con indicadores específicos para cada una de las variables. En virtud de ello se ha llegado a concluir que existe relación entre la investigación policial y la investigación fiscal en los delitos de feminicidio, en el Distrito Judicial de Tumbes 2018-2019, relación significativa 0,762 (Sig. = 0,61 < 0.80). Según el coeficiente de correlación Rho de Spearman, aceptándose con esto la hipótesis general en base a los resultados obtenidos. Adicionalmente, se descubrió que, la variable investigación fiscal tiene una relación directamente proporcional con la variable investigación policial y sus dimensiones; procesos metodológicos, especialización investigación criminal, informe policial análisis cuantitativo y fundamentos científicos.

The main objective of the investigation is to determine to what extent the police investigation is related to the fiscal investigation in the crimes of femicide, in the Fiscal District of Tumbes. Regarding the methodology, the study is quantitative, hypothetical deductive, basic, nonexperimental, descriptive correlational. Likewise, in terms of the sample, it was made up of 15 police officers specialized in criminalistics who belong to the Tumbes Criminalistics Office, added to 78 investigative police officers from DIVINCRI-Tumbes, as well as 09 Prosecutors who belong to the First Provincial Criminal Corporate Prosecutor's Office. of Tumbes, divided into three investigative offices, which have competence in femicide crimes, for which two questionnaires were applied to each group (police personnel and prosecutorial personnel) of the Likert-type polytomous scale, designed with specific indicators for each one. of the variables. By virtue of this, it has been concluded that there is a relationship between the police investigation and the fiscal investigation in femicide crimes, in the Judicial District of Tumbes 2018-2019, significant relationship 0.762 (Sig. = 0.61 < 0.80). According to Spearman's Rho correlation coefficient, accepting with this the general hypothesis based on the results obtained. Additionally, it was discovered that the tax investigation variable has a directly proportional relationship with the police investigation variable and its dimensions; methodological processes, criminal investigation specialization, police report quantitative analysis and scientific foundations.
