Lima. 2013 al 2017(Universidad Privada Norbert Wiener, 2020-09-30) Pinto Gamarra, Richard Manuel; Quiroz Mejía, Jesús MiguelHe objective of this research is to establish the relationship that exists between the fingerprint formulas and the persons accused in homicides of the Peruvian population carried out in the Criminalistics Directorate of the National Police of Peru between the years 2013 to 2017. The type of study is Descriptive, longitudinal, retrospective, nonexperimental design (correlational) and approach quantitative. The population is of Peruvians composed of 2690 persons incriminated in homicides, regardless of their economic situation or if they are primary or recidivist, with a sample constituted by 626 people, of which 565 are men and 61 women. The documentary review technique was used through dactyloscopic (Alphabetic) tabs from which the first variable was obtained, such as dactyloscopic formulas, while for the second variable the types of homicides (qualified, guilty and simple), including the homicide and its attempt were obtained in both sexes and thus from their analysis together obtain a possible formula by sex that demonstrates a possible common pattern of all of them. Among the results we found that if there is a statistically significant relationship of 47% between the fingerprint formulas and the types of homicide of the people incriminated in homicides of the Peruvian population. For the statistical analysis, Pearson's Chi2 was used, completing said relationship in percentage of the summary table of contingency coefficients, with a significant value in both index fingers in men being the higher valued in law with 53.5%; and in women, a significant value was also found in both middle fingers, with a higher value in the left with 81.2%. Finally, a coincidence was found in the finger type and subtype (4 / i) on the ring finger of the left hand with 17% in both men and women incriminated in homicides, which could indicate the existence of a possible pattern common finger.Publicación Acceso abierto Análisis de la supremacía constitucional de los derechos fundamentales en materia laboral individual en las sentencias del Tribunal Constitucional durante el periodo 2007-2016(Universidad Privada Norbert Wiener, 2020-01-18) Lora Brenner, Carlos Armando; Tafur Portilla, Raúl ArturoThe present investigation is based on determining the relationship between the Constitutional Supremacy and the sentences of the Constitutional Court, in individual labor matters, for which a general negative hypothesis has been formulated, while it is proposed that the sentences of the Constitutional Court in Individual labor matters are not related to the concept of Constitutional Supremacy, since for its drafting the fundamental labor rights protected by the Magna Carta are not considered. In order to carry out this investigation, the Constitutional Court judgments in individual labor matters, from 2007 to 2016, which total 759 sentences and a sample of 86 sentences of the referred period have been taken as a population. Two qualitative variables have been considered, the first referring to the constitutional supremacy of fundamental labor rights and the second variable concerning the judgments of the Constitutional Court in individual labor matters. For the purposes of the investigation, variable 1, constitutional supremacy of fundamental rights in labor matters, has been operationalized, which is operationalized in two dimensions on the application of standards, in the same way variable 2, judgments of the Constitutional Court in labor matters individual, in five dimensions, that constitute the fundamental constitutional labor rights that are protected in the amparo process that are raised by affectation to this type of rights; For this, the right to dignity, work as duty and right, the right to equal opportunities without discrimination, the right to the inalienable nature of the rights recognized by the Constitution and the law, and the right to interpretation have been considered favorable to the worker in case of insurmountable doubt about the meaning of a norm. For the purposes of data collection, a Data Collection Card has been prepared, in order to record the results values of the indicators, which consist in the application or not of the fundamental rights in the text of the sentences, obtaining dichotomous results. From the result of the collection of the information obtained, making the verification of these data, it has been found that only 25.58% of the component judgments of the sample base their position on a fundamental right, of which 9.1% apply for resolution of the sentence constitutional principles, which is equivalent to two sentences out of a total of 22 sentences. On the other hand, it is found that 45.5% of sentences that are part of this group of sentences that base their position on a fundamental right, apply norms with the rank of law in their livelihood. By these data it is confirmed that the sentences of the Constitutional Court in individual labor matters, have no constitutional basis in their foundations, confirming the general hypothesis raised, although statistically it has been found that the database worked is not significant.Publicación Acceso abierto Análisis de las impresiones queiloscópicas con la clasificación Suzuki y Tsuchihashi en alumnos de la facultad de Odontología de la Universidad Central del Ecuador, año 2016(Universidad Privada Norbert Wiener, 2017-09-28) Chango Iza, Roberto Delfin; Reátegui Ramírez, RaúlThe present work of investigation has as principal aim verify that the impressions queiloscópicas are only with the Classification Suzuki and Tsuchihashi in the pupils of the Faculty of Odontolgy of the Central University of the Ecuador, year 2016; of basic type, of not experimental design, of quantitative approach, the sample belonged 100 students of the eighth semester, the technology was the survey and the instrument was of a Card Queiloscópica proposed by Carvajal and other (2014). It is observed that there is good agreement (0.763) between Thevenon - Roland Electronic Arm and the BLUESTAR Identi-HEM for the detection of blood stains. Concluding that Thevenon– Roland Electronic Arm is effective for the detection of blood stains analyzed at the Institute of Legal Medicine and Forensic Sciences - Callao, 2019.Publicación Acceso abierto Efecto de Aldicarb y Metamidofos en la tasa de desarrollo de Chrysomya Albiceps, Cochliomyia Macellaria e intervalo Postmortem(Universidad Privada Norbert Wiener, 2021-08-06) Canales Guillén, José Luis; Jáuregui Montero, José AntonioThe importance of ghouls is known in the field of forensic investigations, since they are considered indicators of time of death or portmorten interval, however, there are factors that can influence them, such as the presence of certain toxins involved in the deaths either caused or accidental. In this sense, the objective of the present investigation was to determine the effects that the pesticides aldicarb and metamidifos exert on the biological development of two of the main species of forensic interest Chrysomya albiceps and Cochliomyia macellaria that are used for the evolution of the portmorten interval in the sciences. Forensics For this, three different doses 0.5LD50, LD50 and 2xLD50 of both toxic substances were inoculated in the food of these species. Post embryonic growth curves of Chrysomya albiceps and Cochliomyia macellaria were elaborated, based on length (mm), development time, taking into account the three doses of both pesticides; the rearing of both species was an average environmental temperature of 28.5 ºC, and an average relative humidity of 58.3%., which estimated the Postmortem interval (IPM). Based on the results of the present investigation, it can be concluded that the pesticides aldicarb and methamidophos inoculated at three different doses in their food (0.5LD50, LD50 and 2xLD50), influence the development rate of the two species Cochliomyia macellaria and Chrysomya albiceps, considered forensic indicators, this will inevitably influence the establishment of the Postmorten interval.Publicación Acceso abierto Eficacia de identificación humana por estudio de imágenes del pabellón auricular en una muestra de usuarios de la División Médico Legal de Chachapoyas, 2019(Universidad Privada Norbert Wiener, 2020-06-23) Herrera Paisig, Raul Enrique; Quiroz Mejía, Jesús MiguelThe objective of this study was to establish the effectiveness of human identification through an imaging study of the auricular pavilion, in a sample of users of the Legal Medical Division of Chachapoyas - 2019. This study of observational, descriptive and comparative methodology, analyzed 45 atrial pavilions corresponding to the users, women and men, of the different services provided by the Chachapoyas Legal Medical Division. In order to demonstrate the effectiveness of the study of the auricular pavilion as an identification method, it was carried out by means of the analysis of the Aiken coefficient, assuming a level of statistical significance considered as valid. The results showed that the human identification by study of images of the region of the helix, antihelix, shell and lobe, is effective due to the concordance with its morphology, dimensions and individualizing characters, assuming a level of statistical significance for the case of the Helix of p = 0.001, considered valid; in the case of the antihelix of p = 0.001, considered as valid; in the case of the shell of p = 0.001, considered as valid, and in the case of the lobe of p = 0.049, considered as valid. Likewise, a probability was established that an atrial pavilion is repeated with the same height and width measurements is 0.0222, indicating that the event can occur remotely. Concluding that the human identification by study of images of the auricular pavilion is effective for the concordance with its morphology, dimensions and individualizing characters of the regions of the helix, antihelix and atrial shell, in a sample of users of the Legal Medical Division of Chachapoyas.Publicación Acceso abierto Eficacia del antígeno prostático específico y la fosfatasa ácida en la detección de fluido seminal en prendas de vestir pertenecientes a mujeres víctimas de violación sexual en la División Médico Legal II Lima - norte, año 2017 – 2018(Universidad Privada Norbert Wiener, 2019-11-16) Márquez Guzmán, Christian Jesús; Quiroz Mejía, Jesús MiguelAn investigation was carried out using the prostate specific antigen (PSA) and acid phosphatase (FA) test, with the aim of determining its effectiveness in relation to the detection of seminal fluid in clothing, also the search for sperm was performed by microscopic observation (MC) as a confirmatory test for the detection of this type of fluid; 129 clothing items such as tricks, pants and shorts, belonging to women victims of rape were analyzed according to legal medical examination. The reliable presence of seminal fluid was detected in 90 garments (70%) checked by the positive results to the MC; seminal components such as: PSA in 94 garments (73%), FA in 88 garments (65%); in 39 samples (30%) the presence of seminal fluid was not detected; the integral analysis of the data obtained revealed 4 types of associations of results with variations of positivity and negativity of the tests, being 82 (64%) the I (PSA +, FA +, MC +), 2 (1.5%) the II (PSA +, FA -, MC -), 8 (6%) the III (PSA +, FA -, MC +) and 2 (1.5%) the IV (PSA +, FA+, MC -). The statistical analysis applied to the results reflected a well-marked positive correlation in relation to the results obtained by the PSA and MC association with a statistical value p0.05 and a Spearman correlation index (rho) of 0.9270 closer to 1, in comparison to the one obtained by the FA and MC test that showed a value (rho) of 0.8286, statistically determining a greater association and interdependence relationship between the results of the PSA and MC tests; 100% efficacy was also determined in terms of the detection of seminal fluid in garments by using the PSA test in relation to 91% effectiveness of the FA test, corroborated by the positive microscopy results.
