Abstract

En el presente informe jurídico se analiza el desarrollo de la demanda por despido arbitrario y pago de devengados relacionado al expediente 01185-2013-0-1801- JR-LA-02, el cual inicia con la demanda interpuesta por Juan Manuel Martínez Guerrera con fecha 15 de enero del año 2013 en contra de la empresa RELIMA AMBIENTAL SA y la MUNICIPALIDAD DE LIMA METROPOLITANA. En donde en primera instancia, el juez decide justificar dos días de los seis días de faltas injustificadas, faltas que dieron origen al despido por causa justa relacionado al comportamiento del trabajador, tipificado en el artículo 25, inciso h de la Ley de productividad y competitividad laboral. El juez de primera instancia decide aplicar el principio de primacía de la realidad, concluyendo que la presentación de dos documentos (receta única estandarizada y constancia de atención odontológica) presentados recién en la interposición de la demanda, eran suficientes para justificar dos días de inasistencias, declarando fundada la demanda en primera instancia. Finalmente, la Corte Superior de justicia se pronuncio sobre el recurso de apelación de la empresa RELIMA, revocando la sentencia de primera instancia, reformándola, la declara infundada, basándose en la no justificación de manera oportuna de dichas faltas injustificadas.

This legal report analyzes the development of the lawsuit for wrongful dismissal and payment of back wages related to case file 01185-2013-0-1801-JR-LA-02, which began with the lawsuit filed by Juan Manuel Martínez Guerrera on January 15, 2013, against the company RELIMA AMBIENTAL SA and the Metropolitan Municipality of Lima. In the first instance, the judge decided to justify two of the six days of unjustified absences, absences that gave rise to the dismissal for just cause related to the employee's conduct, as stipulated in Article 25, subsection h of the Law on Labor Productivity and Competitiveness. The trial judge decided to apply the principle of primacy of reality, concluding that the presentation of two documents (a standardized prescription and proof of dental care), submitted only at the time the lawsuit was filed, were sufficient to justify two days of absence, thus ruling in favor of the plaintiff in the first instance. Finally, the Superior Court of Justice ruled on the appeal filed by the company RELIMA, overturning the trial court's decision and declaring the plaintiff's absence unfounded, based on the failure to provide timely justification for said unjustified absences.
