Informe Jurídico sobre Expediente N°116-2020-JNJ

Abstract

En este trabajo jurídico, se llevará a cabo un análisis detallado del proceso disciplinario inmediato relacionado con el expediente N°116-2020-JNJ, seguido por la Junta Nacional de Justicia (JNJ) contra Luis Carlos Arce Córdova, debido a su conducta irregular durante su desempeño como fiscal supremo miembro del Pleno del Jurado Nacional de Elecciones (JNE). El procedimiento se inicia el 2 de julio de 2020 a través de la Resolución N°020- 2020-PLENO-JNJ. Consecuentemente, el fiscal investigado presenta su descargo mediante escrito de fecha 21 de julio de 2020, solicitando se declaren infundados los cargos en su contra y la nulidad de todo lo actuado. Posteriormente, mediante la Resolución N°042-2021-PLENO-JNJ, el Pleno de la JNJ concluye el proceso y dispone la destitución del fiscal supremo por incurrir en faltas muy graves, tipificadas en el Artículo 47° de la Ley de la Carrera Fiscal (Ley N°30483). El 13 de julio de 2021, Arce Córdova interpone un recurso de reconsideración, argumentando que el procedimiento disciplinario ha incurrido en diversas nulidades que vulneran sus derechos fundamentales y el debido proceso. En sesión plenaria del 16 de julio de 2021, la JNJ admite a trámite el recurso. Sin embargo, el recurrente no asiste a la audiencia programada para el 29 de septiembre de 2021, ni presenta justificación alguna, a pesar de haber sido debidamente notificado, por lo que la causa se somete a votación. Finalmente, mediante la Resolución N°017-2022-PLENO-JNJ, el Pleno de la JNJ declaró infundado el recurso de reconsideración, confirmando la destitución de Arce Córdova y agotando la vía administrativa. A partir de lo actuado, se procederá a identificar y analizar los principales problemas jurídicos del caso, conforme a la normativa vigente y a la doctrina aplicable.

In this legal document, a detailed analysis will be conducted of the immediate disciplinary proceedings related to File No. 116-2020-JNJ, brought by the National Board of Justice (JNJ) against Luis Carlos Arce Córdova, due to his irregular conduct during his tenure as Supreme Prosecutor and member of the Plenary Session of the National Elections Jury (JNE). The proceedings began on July 2, 2020, through Resolution No. 020-2020-PLENO-JNJ. Consequently, the prosecutor under investigation filed his defense in a letter dated July 21, 2020, requesting that the charges against him be declared unfounded and that all proceedings be annulled. Subsequently, through Resolution No. 042-2021-PLENO-JNJ, the Plenary of the JNJ concluded the proceedings and ordered the dismissal of the Supreme Prosecutor for committing very serious offenses, as defined in Article 47 of the Public Prosecutor's Career Law (Law No. 30483). On July 13, 2021, Arce Córdova filed an appeal for reconsideration, arguing that the disciplinary proceedings had incurred various nullities that violated his fundamental rights and due process. In a plenary session on July 16, 2021, the JNJ admitted the appeal for processing. However, the appellant did not attend the hearing scheduled for September 29, 2021, nor did he present any justification, despite having been duly notified, so the case was put to a vote. Finally, through Resolution No. 017-2022-PLENO-JNJ, the Plenary of the JNJ declared the appeal for reconsideration unfounded, confirming Arce Córdova's dismissal and exhausting administrative remedies. Based on the actions taken, the main legal issues in the case will be identified and analyzed, in accordance with current regulations and applicable legal doctrine.
