Abstract

El presente estudio tiene por finalidad realizar un análisis jurídico integral del Expediente N.° 12721-2017-0-1801-JR-FC-04, revisado posteriormente en sede superior y culminado con la Casación N.° 6811-2019-LIMA, dentro de un proceso de régimen de visitas. Este caso plantea importantes interrogantes sobre los alcances, límites y condiciones para que los familiares distintos a los progenitores ejerzan su derecho de mantener vínculos afectivos con los niños, siempre bajo el amparo del interés superior del niño. Jurídicamente, el expediente aborda materias esenciales del Derecho de Familia, particularmente respecto al régimen de visitas y a la preservación de las relaciones del niño con su entorno familiar. Al mismo tiempo, compromete aspectos del Derecho Procesal de Familia, al analizar la tramitación del proceso único, la actuación de la prueba, la intervención del Ministerio Público y el razonamiento judicial desarrollado en las distintas instancias. Además, se vincula con el Derecho Constitucional y los Derechos Humanos, dado que se evalúan principios como el interés superior del niño, la protección de la familia y el derecho del menor a mantener contacto con su familia extensa, conforme al artículo 9.3 de la Convención sobre los Derechos del Niño.

The purpose of this study is to conduct a comprehensive legal analysis of Case File No. 12721-2017-0-1801-JR-FC-04, subsequently reviewed by a higher court and culminating in Cassation No. 6811-2019-LIMA, within a visitation rights proceeding. This case raises important questions regarding the scope, limits, and conditions under which relatives other than the parents may exercise their right to maintain emotional bonds with children, always under the protection of the best interests of the child. Legally, the case file addresses essential matters of Family Law, particularly regarding visitation rights and the preservation of the child's relationships with their family environment. At the same time, it involves aspects of Family Procedural Law, by analyzing the handling of the single proceeding, the presentation of evidence, the intervention of the Public Prosecutor's Office, and the judicial reasoning developed at the various stages of the proceedings. Furthermore, it is linked to Constitutional Law and Human Rights, since principles such as the best interests of the child, the protection of the family and the child's right to maintain contact with his extended family are evaluated, in accordance with article 9.3 of the Convention on the Rights of the Child.
