Resumen
La presente tesis tiene como objetivo determinar la relación que existe entre la Peritaje Psicológico y las Sentencias Condenatorias en las menores agraviadas en los delitos de Violación Sexual en la Corte Superior de Cañete entre los años 2019–2021 y se ocupa de la valoración del Peritaje Psicológico en las sentencias condenatorias de Violación Sexual de Menores acorde a lo dispuesto en el Artículo 393 inciso segundo del Código Procesal Penal. El enfoque de la investigación es cuantitativo. Se someten a un análisis estadístico, siendo el tipo aplicado asimismo se establece un diseño ex post facto. La población es de 80 expedientes judiciales teniendo una muestra censal, la técnica que emplea es la observación de documentos asimismo se utiliza los instrumentos como registro de recolección de datos de resoluciones judiciales, el procesamiento y análisis se materializa a través de una estadística descriptiva e inferencial. Finalizando la investigación se pudo confirmar nuestras hipótesis planteadas logrando determinar con éxito que las Pericias Psicológicas guarda correlación positiva en la valoración con las sentencias penales condenatorias en los delitos de Violación Sexual de Menores en la Corte Superior de Justicia de Cañete en los años 2019-2021, por lo tanto, se colige que las Pericias Psicológicas en su valoración permitieron materializar las Sentencias Condenatorias a los imputados condenados.
Resumen
The objective of this thesis is to determine the relationship that exists between the Psychological Expertise and the Convictions in minors aggrieved in the crimes of Sexual Rape in the Superior Court of Cañete between the years 2019-2021 and deals with the assessment of the Psychological Expertise in convictions of Sexual Violation of Minors in accordance with the provisions of Article 393, second paragraph of the Code of Criminal Procedure. The research approach is quantitative. They are subjected to a statistical analysis, being the type applied, an ex post facto design is also established. The population is 80 judicial files having a census sample, the technique used is the observation of documents, the instruments are also used as a record of data collection of judicial decisions, the processing and analysis is materialized through descriptive and inferential statistics. . At the end of the investigation, it was possible to confirm our hypotheses, successfully determining that the Psychological Expertise has a positive correlation in the assessment with the criminal convictions in the crimes of Sexual Rape of Minors in the Superior Court of Justice of Cañete in the years 2019-2021 , therefore it is inferred that the Psychological Expertise in its assessment allowed materializing the Convicting Sentences of the convicted defendants.
