The objective of this thesis is to understand the legal scope of the authentic degree, qualification and registration in the Peruvian constitutional jurisprudence regarding the protection of property rights, Lima 2015-2020. The approach with which the research is approached is qualitative, through the case study, using national and comparative regulations, resolutions of the Constitutional Court, classical and updated grounded doctrine, interview specialists as techniques for obtaining data those that are analyzed from an analytical and interpretive perspective that responds to the stated objectives and referred techniques. Scientific rigor is ensured through criteria of credibility, transferability, security / auditability and confirmability with which it is obtained as results, by triangulation, the verification of the existence of jurisprudential criteria that contain requirements greater than those established by law, this allows us to conclude on the need to formulate definitions of the categories, including those that may need the design of a new registry system.
Resumen
El objetivo de la presente tesis es comprender los alcances jurídicos de la titulación auténtica, calificación e inscripción registral en la jurisprudencia constitucional peruana respecto de la protección de los derechos de propiedad, Lima 2015-2020. El enfoque con que se aborda la investigación es cualitativo, mediante el estudio de caso, recurriéndose a normativa nacional y comparada, resoluciones del Tribunal Constitucional, doctrina fundamentada clásica y actualizada, entrevista a especialistas como técnicas para la obtención de datos los que se analizan desde una perspectiva analítica e interpretativa que responde a los objetivos planteados y técnicas referidas. El rigor científico se asegura mediante criterios de credibilidad, transferibilidad, seguridad/auditabilidad y confirmabilidad con los que se obtiene como resultados, mediante triangulación, la constatación de la existencia de criterios jurisprudenciales que contienen exigencias mayores a las establecidas normativamente, lo que permite concluir por la necesidad de formular definiciones de las categorías comprendidas las que pueden necesitar del diseño de un nuevo sistema registral.
