The research methodology used is a qualitative approach, with an inductive method, its design was based on grounded theory and using the documentary analysis technique, for the collection of information the documentary analysis guide instrument was applied. The study was carried out in relation to 5 files with acquittal in cases of crimes against sexual freedom of the departments such as: Ancash, San Martin, Cajamarca, Piura, the criteria considered were cases of acquittal sentences of life imprisonment, sentences that supported its decision with the medical expertise of minors under 11 years of age and finally that the research participants are under 11 years of age. Among its results, an inadequate praxis is identified in the official medical expertise in cases of sexual abuse in the country; The sentences analyzed establish the importance of the forensic medical expertise of the party in the Peruvian criminal process by allowing to base a sentence of acquittal of life imprisonment and finally forensic medical criteria with scientific rigor are established in relation to sexual abuse in the age group of minors. 11 years. The conclusion of the investigation shows that the forensic medical expertise on the part has served as the basis for the acquittal of life imprisonment cases by demonstrating the poor assessment and evaluation that was carried out in the official medical expertise.Publicación Acceso abierto Aplicación del reactivo fosfatasa acida de uso clínico para la determinación de presencia de fluido seminal con fines forenses en el laboratorio clínico H y D salud – 2021(Universidad Privada Norbert Wiener, 2022-03-11) Montenegro Villegas, Fany Yakeliny; Casana Jara, Kelly MilagritosSex crimes in our country according to statistical indices are high and are considered a public health problem that needs immediate attention, on the part of the entities that administer justice, using scientific evidence that helps to clarify said crimes, Therefore, we carried out the present investigation that aimed to evaluate the extent to which the acid phosphatase reagent for clinical use detects the presence of seminal fluid for forensic purposes in the Clinical Laboratory H Y D Salud– 2021. Regarding the methodology, is of an applied type, with a quantitative approach and an experimental design since numerical checks and statistical analysis were made to give a possible solution to the problem found through the manipulation of the variables; On the other hand, to collect the data, an observation card was used which was applied to the sample made up of the entire population, that is to say, census sampling, which in this case were 20 samples of seminal fluid in two types of fabric backing (cotton and synthetic). As results, it was obtained that the acid phosphatase reagent for clinical use detects the presence of seminal fluid in stock solution, 1/10 solution, 1/100 solution and 1/1000 solution both in synthetic cloth support and cotton cloth support; On the other hand, it was found that the acid phosphatase reagent for clinical use has significant differences in the detection of the acid phosphatase enzyme on cotton cloth support and on synthetic cloth support evaluated in the different solution groups. The ASI is a very worrying phenomenon, however, the research on this topic in Peru is very scarce and more specifically in the different regions of the country, so in the present research work the forensic clinical characteristics of sexual abuse in minors are described. of age evaluated in the Legal Medical Unit (UML) Cajabamba (Peru) during the years 2018 to 2020; 164 legal medical certificates made by health professionals were analyzed. Among the findings we have: the average age of the minors was 12 years. 49.39% of the victims had primary education, of which 27.44% presented a recent tear, resulting in the most frequent type of hymen: the annular in 35.37%. On the other hand, 67.07% of the alleged attacks occurred on a working day and 31.10% of the alleged attacks were in a public place (outdoors such as in a park). The most frequent alleged aggressors were family acquaintances (31.71%). Lastly, in 38.41% of the presumed assaults, the presumed aggressor offered money. Basic-correlational, non-experimental, with a quantitative approach. Non-probabilistic-stratified sample, with 80 participants. For data collection, questionnaires were applied, which were validated and with high reliability, the Spearman Rho statistic was used for the general and specific inference tests. The results were: 40% of the operators have a low level, 32.50% have a medium level and 27.50% have a high level. Conclusion: there is a relationship (Rho = 0.946), significance p value = 0.000 <0.05 and high positive correlation, dismiss the null hypothesis. This research is deductive method, quantitative approach, applied type, non-experimental design, 200 files were used. Obtaining a result that drug use with crimes against property and illicit drug trafficking have an inversely proportional relationship since it shows in its coefficient of Spearman's Rho = -0.432 indicating a moderate negative correlation, and the p-value= 0.000 which indicates that it rejects the null hypothesis and accepts the subordinate hypothesis and with the crime of violence it does not have a direct relationship, therefore it is concluded that to commit crimes such as robbery, micro-commercialization and violence it is not necessary to be under the drug effect.Publicación Acceso abierto Consumo de drogas y las infracciones a la ley penal cometidas por menores intervenidos por la DEPINCRI Callao - 2022(Universidad Privada Norbert Wiener, 2023-09-27) Herrera Hurtado, Zulmi; Casana Jara, Kelly MilagritosThis research has had the objective of “Establishing the relationship between drug consumption and violations of criminal law committed by minors intervened by Depincri Callao 2022.” For this reason, we worked with a basic or also called pure type research and with a correlational scope. The design used in said research was non-experimental. As a sample, there were 198 cases of “infractions committed by minors intervened by the Depincri Callao in 2022.” The document analysis instrument was developed according to the indicators of each variable. Purpose. Determine the relationship of the timely compliance with the ballistics expertise in the preliminary investigation of flagrante delicto crimes in the corporate criminal provincial prosecutor's offices of Los Olivos, 2019. Methodology. Deductive method, nonexperimental design - descriptive and basic type. The population was made up of the Tax Folders that were carried out in the Los Olivos Provincial Criminal Criminal Prosecutor's Offices, year 2019; the sample consisted of 100 fiscal folders, constituted in a non-random way for convenience, which met the inclusion and exclusion criteria. The instrument used was a Data Collection Sheet, prepared by the thesis student in AD-HOC form. Validation was done by Expert judgment and reliability by Cronbach's Alpha. Results. Regarding the timely fulfillment of the ballistics expertise, it does Not comply and in the preliminary investigation It does Not comply by majority in 60%; followed by timely compliance with the ballistics expertise Yes complies, and in the preliminary investigation, Yes complies by 17%. There is a relationship between the variables as p-value = 0.000 (p <0.05).Publicación Acceso abierto La dependencia emocional como factor influyente en las víctimas de violencia intrafamiliar, mujeres entre 25 a 45 años, distrito de Ayacucho 2019(Universidad Privada Norbert Wiener, 2021-07-30) Rivera Mejía, Josué Leive; Casana Jara, Kelly MilagritosThe objective of this study was to determine the relationship between emotional dependence and domestic violence in women between 25 and 45 years old in the district of Ayacucho, 2019. The type of deductive research, quantitative approach, correlational level. The sampling is non-probabilistic; 112 people, from complete secondary to higher education level, were considered as a sample, women who have been victims of violence within the intrafamily context (domestic or partner violence), where 2 instruments were applied that measures the emotional dependence (IDE) created in Peru and another of domestic violence with its dimensions psychological, physical and sexual abuse created by the researcher himself, obtaining as results that the highest percentage of respondents present emotional dependence at a high level 39.3% and 20.5% present emotional dependence at a moderate level, rates that are high. To corroborate and contrast the study hypothesis, it was verified with the Spearman correlation coefficient, where it is concluded that emotional dependence is related to intrafamily violence. These study variables are positively related to each other to a moderate degree (r = 0.560). In other words, it is established that emotional dependence is related to domestic violence in women between 25 and 45 years old. Likewise, it was found that emotional dependence is related to the dimensions of psychological abuse, physical violence and sexual violence, since they presented a significance of less than 5% (p <0.05). Finally, the recommendations of the case are provided, such as: Promotion, prevention and intervention, in order to reduce or eliminate this social problem of family violence and avoid some type of femicide.Publicación Acceso abierto Distorsiones cognitivas y conducta agresiva en presuntos autores de agresión sexual en una Institución Pública del Estado, Lima 2023(Universidad Privada Norbert Wiener, 2023-09-29) Soto Santivañez, Milagros Yulisa; Casana Jara, Kelly MilagritosThere are studies that indicate that sexual offenders present many cognitive distortions, including erroneous beliefs and attitudes, the purpose is to show how cognitive distortions are linked to aggressive behavior, which are involved in sexual aggression, allowing us to prevent, avoid and predict this crime. Objective: To determine the relationship between cognitive distortions and aggressive behaviors of alleged sexual aggressors in a public institution of the State of Lima, 2023. Materials and methods: It has a non-experimental design of correlational level, deductive method of applied research type, quantitative approach, descriptive correlational design. The Cognitive Distortions Scale - EDC instrument was applied, created by the authors are Abel, Gore, Holland, Camp, Becker & Rathner in 1989, adapted in 2016 by Cepeda, Zulma; Ruiz, José in Colombia, which consists of 29 items; with a Crombach's Alpha coefficient of 0.783 and the AQ Aggression Questionnaire created by Buss and Perry in 1992; which contains 29 items, adapted in Spain by Rodríguez et al, Buss and Perry's Aggression Questionnaire adapted to Peru by Matalinares, et al., 2012, obtained an alpha of 0.83 in the reliabilities. Results: In the variable cognitive distortions with 74.07 % is at a high level and aggressive behaviors with 90.12 % are at a high level, also the correlation between cognitive distortions and aggressive behaviors according to Spearman's Rho correlation coefficient is 0.351, which indicates that it is positive. Conclusions: The research shows us that there are significant levels of cognitive distortions that originate a high level of aggressive behaviors.Publicación Acceso abierto Efectividad de los informes periciales evaluados por peritos en hechos de tránsito ocurridos en lima metropolitana, 2017-2019(Universidad Privada Norbert Wiener, 2021-12-04) Infante Zapata, Pedro Jose; Casana Jara, Kelly MilagritosThe objective of this study was to determine the effectiveness of the expert reports evaluated by experts in traffic events that occurred in Metropolitan Lima during the period 2017-2019. This study, with a non-experimental, cross-sectional methodology, with a comparative analytical design, and analyzed 80 experts in traffic events from any part of the nation who participated in the expertise of traffic events in Metropolitan Lima during the period 2017-2, They were selected based on the inclusion and exclusion criteria established for the study. For the statistical analysis, absolute and relative frequencies (%) were used, and for the inferential test the Cohen's Kappa index was performed, considering a p value less than 0.05 as significant. Among the results, it was found that the effectiveness of the intervention data described in the DIPVIAT PNP expert report (standard) is mostly (68.8%) compared to the forensic physical expert report as a complement to the standard expert report with high effectiveness (93.8% ), the effectiveness of the identification of the traffic units consigned in the standard expert report was low (57.5%) compared to the forensic physical expert report with an effectiveness (86.3%), the effectiveness of analytical description is predominantly low (75% ). This study is of a hypothetical-deductive method, quantitative approach, Basic type, observational descriptive correlational, non-experimental, cross-sectional design. The sample is 30 experts from DIVINCRI. The survey was used as a technique and as an instrument, two questionnaires prepared by the researcher. The reliability of the instruments for the independent variable yielded a Cronbach's alpha coefficient of 0.817 and for the dependent variable 0.794, which determines that the instruments are reliable. According to the hypothesis test, the Spearman correlation coefficient indicates a statistically significant, moderate and inversely proportional linear relationship between both variables (rho = - 0.527 (p <0.05)), so the higher the level of contaminating factors, the less evidence Biologicals at the crime scene. Debido a la carente la investigación sobre este tema en nuestro país aún se perpetúan obstáculos significativos, factores que son determinantes en el esclarecimiento de los casos tal como son las evidencias biológicas que muchas veces se vuelven insuficientes en los juicios debido a factores que pueden disminuir la cantidad de muestras. La presente investigación es de tipo básica, nivel correlacional y diseño no experimental busca determinar la relación entre los factores de riesgo de la evidencia biológica con la responsabilidad penal en casos de delitos de violencia sexual en Ica. La muestra de estudio incluyo 166 abogados a quienes se les aplicó un cuestionario, estuvo conformada por 24 preguntas dicotómicas. Entre los resultados destacamos que los factores de riego de perdida de indicios biológicos como en el acto de ducharse representan un 92.2% y posibles pérdidas de muestra biológicas por atención hospitalaria en un 61.4%. El 96,4% destaca el tiempo transcurrido desde la agresión hasta la toma de muestra como un riesgo. Los resultados mostraron relación mediante el estadístico χ2-cuadrado con un valor muestral de 36,632, lo cual concluye que existe una relación significativa entre los factores de riesgo de la evidencia biológica con la responsabilidad penal en casos de delitos de violencia sexual Ica.Publicación Acceso abierto Factores del medio ambiente e influencia en la identificación del grupo sanguíneo en manchas de sangre de interés criminalístico. Lime, 2019. Materials and methods: This research used the hypothetical-deductive method, with a quantitative approach, basic type, non-experimental cross-sectional design and explanatory level. The population consisted of 270 samples consisting of blood stains prepared on polycotton fabrics of blood groups A, B and O, using a non-probabilistic method for selection. The technique used is observation and the data collection instrument was an observation guide. Results: According to the results obtained, we found that the effects of humidity and temperature on group A bloodstains give strongly positive results up to week 7, lowering the avidity to 1+ at week 10. In the case of blood group B stains the effects of humidity and temperature allow to demonstrate positive results up to week 9. No agglutination is observed at week 10. Group O blood spots, subjected to the effects of humidity and temperature, were positive during the ten weeks of the study, but with low avidity at week 10. Conclusions: According to the results obtained, it can be concluded that environmental factors such as humidity and temperature do not significantly influence the determination of blood groups of criminal interest, however, the exposure time can lower the avidity of the results.Publicación Acceso abierto Factores que determinan la prevalencia de la convivencia de la mujer violentada con su agresor. The methodology used consisted of qualitative research, phenomenological design, applying the inductive method. The sample consisted of 6 prosecutors and 6 lawyers specializing in criminal matters and the interview guide was the instrument applied. It was obtained as results that it is pertinent to give answers on how and why it was committed, how it happened, what was the trigger for the act, since it will allow to find an approximate profile of the aggressor and advance with the investigations. It is concluded that the identification of the psychological profile of the offender cooperates in the criminal investigation of the crime of femicide, allowing an approximate profile of the aggressor to be found, the closer the profile is obtained, this will allow the criminal investigation to develop more quickly.Publicación Acceso abierto Observancia del procedimiento para la toma de muestras para analisis de restos de disparos por arma de fuego, Ancash – 2021(Universidad Privada Norbert Wiener, 2022-03-08) Reyna de la Cruz, Javier Enrique; Casana Jara, Kelly MilagritosThe main objective of the investigation is to determine if the experts adequately apply the current procedure in the collection of samples for the detection of residues of firearm shots in Ancash 2021. Regarding the methodology, the study is quantitative, not experimental, descriptive, analytical, inductive, concrete. Likewise, the sample consisted of 20 experts from the Chimbote Criminalistics Office and 15 from the Huaraz Criminalistics Office, making a total of 35 Experts. 34 dichotomous questions and to be able to answer the objectives and hypotheses, the analysis was used, Pearson's Chi-square Statistic will be applied. The results showed that the current procedure used by forensic experts for the detection of residues of firearm shots in Ancash 2021, presents deficiencies in the procedure for taking samples in the hands of people, corpses and clothing, as well as on shot debris by using suitable swabs and containers. The type of research was quantitative, the design was non-experimental, cross-sectional, descriptive, because the relationship between types of organization and types of traumatic patterns was studied, that is, their frequency and distribution in the population made up of 21,918 victims of the internal armed conflict. and a sample of 322 victims from the Ayacucho, Huancavelica and Junín regions was counted. The instrument used was an analysis guide - social and physical anthropological expert reports and the research technique was documentary analysis. The result of the investigation was that there is a significant relationship between the type of organization and the type of traumatic pattern in victims of the internal armed conflict from the Peruvian regions of Ayacucho, Huancavelica and Junín during the years 1980-2000, where evidence traumatic patterns well defined and differentiated by the form and execution mechanisms attributable to each of the organizations that participated in the conflict.
