Publicación Acceso abierto Adaptación psicométrica de la escala para la auto-medición de la depresión de Zung en los pobladores adultos del distrito de Puerto Esperanza – Purús - Ucayali, año 2018(Universidad Privada Norbert Wiener, 2019-02-22) Arquero Carranza, Jhonatan Elí; Quiroz Mejía, Jesús MiguelThe present psychometric research sought to adapt, through the knowledge of the psychometric properties of the Scale for the self-measurement of the depression of Zung in the adult inhabitants of the district of Puerto Esperanza - Purús - Ucayali, year 2018, having as a target population 410 adult residents of Purusinos , establishing a sample of 350 adult settlers of both genders, ranging from 18 to 65 years of age. The instrument used was the Scale for the Self-measurement of Depression (EAMD) of Zung, The results of the psychometric adaptation show high rates of the Scale for the self-measurement of Zung's depression; the validity of 100% unit content in the Criteria of Judges and / or Experts, a good (elevated) construct validity through confirmatory factor analysis - unifactorial model; with an internal consistency index, through Mc Donald's Omega of 0.983; Finally, the scale was obtained through percentile scores, obtaining local scales by sex with their respective cut-off points (4 categories).Publicación Acceso abierto Ajuste de cuentas por narcoraficantes ante la Investigación en la escena del crimen: Estudios de casos en zona del VRAEM, Ayacucho -2020(Universidad Privada Norbert Wiener, 2022-12-07) Garcia Durand, Navil; Montellanos Cabrera, Henry SamThe study approached the topic crime scene and the adjustment of accounts for drug trafficking, where the main objective was to explain the investigation of the adjustment of accounts by members of drug trafficking in the crime scene in the area of VRAEM, Ayacucho, 2020. Whose approach was from the research methodology of basic type, of meso dimension, whose temporality comprises synchronic, the research design corresponds phenomenological and the method was hermeneutic, of explanatory analysis level; the sample of the study was conformed by 9 forensic experts and 3 prosecutors under the criterion of content saturation, also the technique and instrument comprises interview and semi-structured interview guide. The results obtained allowed explaining that the criminal investigation at the crime scene has deficiencies due to the existence of risk factors that prevent the proper development of investigation protocols and intervention of the authority. Where it was concluded that: there is a deficiency due to the fact that it has not been possible to evidence an adequate approach to the protocol, since there is no rapid intervention, nor isolation, nor adequate demarcation of the crime scene due to the existence of human and environmental contaminating agents.Publicación Acceso abierto Análisis de fórmulas dactiloscópicas y su relación con las personas incriminadas en homicidios de la población peruana, realizado en la Dirección de Criminalística de la Policía Nacional del Perú. Lima. 2013 al 2017(Universidad Privada Norbert Wiener, 2020-09-30) Pinto Gamarra, Richard Manuel; Quiroz Mejía, Jesús MiguelHe objective of this research is to establish the relationship that exists between the fingerprint formulas and the persons accused in homicides of the Peruvian population carried out in the Criminalistics Directorate of the National Police of Peru between the years 2013 to 2017. The type of study is Descriptive, longitudinal, retrospective, nonexperimental design (correlational) and approach quantitative. The population is of Peruvians composed of 2690 persons incriminated in homicides, regardless of their economic situation or if they are primary or recidivist, with a sample constituted by 626 people, of which 565 are men and 61 women. The documentary review technique was used through dactyloscopic (Alphabetic) tabs from which the first variable was obtained, such as dactyloscopic formulas, while for the second variable the types of homicides (qualified, guilty and simple), including the homicide and its attempt were obtained in both sexes and thus from their analysis together obtain a possible formula by sex that demonstrates a possible common pattern of all of them. Among the results we found that if there is a statistically significant relationship of 47% between the fingerprint formulas and the types of homicide of the people incriminated in homicides of the Peruvian population. For the statistical analysis, Pearson's Chi2 was used, completing said relationship in percentage of the summary table of contingency coefficients, with a significant value in both index fingers in men being the higher valued in law with 53.5%; and in women, a significant value was also found in both middle fingers, with a higher value in the left with 81.2%. Finally, a coincidence was found in the finger type and subtype (4 / i) on the ring finger of the left hand with 17% in both men and women incriminated in homicides, which could indicate the existence of a possible pattern common finger.Publicación Acceso abierto Análisis de huellas labiales de Renaud como método de identificación forense en estudiantes de una universidad privada año 2023(Universidad Privada Norbert Wiener, 2023-08-31) Mendoza Corbetto, Marco Antonio; Neyra Rivera, Carlos DavidThe purpose of this research work is to validate the analysis of Reanud lip prints as a forensic identification method in students of a private university in 2023, through a type of applied research, with a non-experimental design and with a quantitative approach; with a sample of 132 students, using the observation as a technique and as an instrument the cheiloscopic file validated by Carvajal and others (2014) It was found that the type B groove was the most prevalent, with an 83.3% prevalence, that the commissure of the dejected type was exhibited as the most frequent, presenting in 68.9% of the cases and that the thickness of the medium lip was the most predominant with 66.7% Also, it was shown that lip impressions are unique with Renaud's analysis and the cheiloscopic pattern was not repeated in any of the 132 students, this method being valid as a method of forensic identification of people.Publicación Acceso abierto Análisis de la pericia médico forense de parte en absolución de casos de abuso sexual en el Perú 2011-2021(Universidad Privada Norbert Wiener, 2023-05-09) Chirinos Castro, Carlos Alberto; Casana Jara, Kelly MilagritosThe objective of this research is to analyze the forensic medical expertise of the party in the acquittal of cases of sexual abuse in Peru 2011-2021. The research methodology used is a qualitative approach, with an inductive method, its design was based on grounded theory and using the documentary analysis technique, for the collection of information the documentary analysis guide instrument was applied. The study was carried out in relation to 5 files with acquittal in cases of crimes against sexual freedom of the departments such as: Ancash, San Martin, Cajamarca, Piura, the criteria considered were cases of acquittal sentences of life imprisonment, sentences that supported its decision with the medical expertise of minors under 11 years of age and finally that the research participants are under 11 years of age. Among its results, an inadequate praxis is identified in the official medical expertise in cases of sexual abuse in the country; The sentences analyzed establish the importance of the forensic medical expertise of the party in the Peruvian criminal process by allowing to base a sentence of acquittal of life imprisonment and finally forensic medical criteria with scientific rigor are established in relation to sexual abuse in the age group of minors. 11 years. One thought that the type of thickness of the most frequent lip was the medium one in 46 % of the students; that the type of the most frequent labial commissure was brought down in 53 % of the students; that the type of labial rut that prevails for sex is of the type the IInd (both in women and in men). There was demonstrated that the impressions queiloscópicas are only with the Classification Suzuki and Tsuchihashi in the pupils of the Faculty of Odontolgy of the Central University of the Ecuador, on the basis of the analysis of four quadrants of the lips effected.Publicación Acceso abierto Análisis de perfiles genéticos mezcla y su aplicación en evidencias forenses de violencia sexual de mujeres peruanas en UNBIMOG 2019-2020(Universidad Privada Norbert Wiener, 2022-10-22) Bermejo Valladolid, Maria Estilita; Montellanos Cabrera, Henry SamFor the analysis of genetic mixture profiles, the objective of this study was to apply interpretation criteria of the analysis of genetic mixture profiles, in forensic evidence of sexual violence of Peruvian women, in the Molecular and Genetic Biology Unit; 2019-2020. The research design is non-experimental, applied, cross-sectional and descriptive. 141 forensic evidence from 36 criminalistics cases were analyzed where it was possible to determine that the genetic profiles met the criteria for general interpretation of mixed profiles, for which 98% exceeded the analytical threshold (≥ 50 RFU), 82% exceeded the threshold stochastic (≥ 150-200 RFU), 60% exceeded the stutter threshold (≥ 10-15% RFU), 92% presented heterozygote imbalance (< 0.6), the proportion of contributors 0.1-1 was distinguishable in 62 %, the extrabands recognizable in 60% were the stutters, the presence of genetic artifacts was in 44% and the stochastic, degraded and/or inhibited profiles are related to the types of mixture profiles. In the criminal cases of a single aggressor, they met the general thresholds of scientific recommendation, likewise the mixed profiles were interpretable, the conclusive cases were in 78 pieces of evidence and the inconclusive cases were in 13 pieces of evidence. In the criminal cases of multiple aggressors, the mixed profiles met the general thresholds of scientific recommendation, likewise these profiles were interpretable, the conclusive cases were 41 pieces of evidence and the inconclusive cases were 9 pieces of evidence.Publicación Acceso abierto Análisis técnico de la reconstrucción de los accidentes de tránsito y la responsabilidad penal en el Distrito de Echarati, 2019-2022(Universidad Privada Norbert Wiener, 2023-08-31) Rios Taculi, Alexander; Jáuregui Montero, José AntonioThe purpose of the investigation was to know the effects that the implementation of the technical analysis of the reconstruction of traffic accidents would have on the determination of criminal responsibility in the district of Echarati - Cusco; 2019-2022, the same one that was carried out under the qualitative approach with a phenomenological design. The techniques used have been the documentary analysis of five police reports of reconstruction in traffic accidents and the interview of five specialists, whose selection criteria have been based on their specialty and field of action, for which reason, they have been part of the sample, two experts specialized in traffic accidents from the Traffic Accident Prevention and Investigation Unit – UPIAT Cusco; an expert in traffic accidents from the PNP Echarati Police Station; and two magistrates of the Judiciary specializing in criminal law, which allows us to show a high level of reliability for the results found. From the results of the present investigation, it has been possible to establish that the reconstruction of traffic accidents is very important to establish the criminal responsibility of the defendants; however, due to the lack of preparation of the intervening police officers, an adequate treatment of the evidence found in the event is not carried out; in the same way, a perpetuation of the transit event is not carried out that prevents the alteration of the scene until the arrival of the experts; consequently, the phases of the transit event are not determined; what causes, the loss of evidence; which causes the reconstruction to be incomplete and historical.Publicación Acceso abierto Aplicabilidad del Método de Widmark y factores asociados en los casos de alcoholemia registrados en la Unidad Desconcentrada de Dosaje Etílico, Lambayeque, 2022(Universidad Privada Norbert Wiener, 2023-03-04) Príncipe Ferrer, David William; Montellanos Cabrera, Henry SamObjective: To determine the applicability of the Widmark Method and the associated factors in the cases of alcoholemia registered in the Decentralized Unit of Ethyl Dosage, Lambayeque, 2022 Methodology: The type of research of the study was analytical, of descriptive design, it had a population of 1130 people intervened in the Decentralized Ethyl Dosage Unit of the city of Chiclayo, Lambayeque from which a representative sample of 287 intervened people was obtained. The data collection was obtained through documentary analysis of the files of said area during the period May - July 2022, for which inclusion and exclusion criteria were applied, in the analysis of the data descriptive statistics were applied with a level of significance of 0.05. Results: The demographic factors associated with the cases of breathalyzer according to the age range was from 31 to 40 years with 38.0%; the male sex with 82.6%; married people with 53.0%, with a "secondary" level with 48.1%; blood alcohol levels were included in the drunken period with levels from 0.50 to 1.50 g/L (62.4%); followed by the "subclinical" period with levels of less than 0.50 g/L (18.5%); the period of absolute intoxication with levels of 1.50 to 2.5 g/L (14.6%) and the lowest percentage period of severe alteration of consciousness with levels of 2.5 to 3.5 g/L (4.5 %); Regarding the average latency time in the sampling, it was 3 to 5 hours, with a percentage of 71.8%. A medium applicability of the Widmark Method is observed. Conclusions: An average applicability of the Widmark Method was determined in the cases of breathalyzer registered in the Decentralized Unit of Ethyl Dosage, Lambayeque, 2022.Publicación Acceso abierto Aplicación de las técnicas de la inmunocitoquímica psa y citoquímica pas para el reconocimiento e identificación de espermatozoides en muestras forenses por violencia sexual en el Hospital Nacional Alberto Sabogal Soleguren, 2017(Universidad Privada Norbert Wiener, 2019-02-13) García Vásquez, Carlos Hugo; Fox Cortez, Julio AlonsoThe main objective of this research is to determine the relationship between the application of the techniques of immunocytochemistry PSA (Prostate Specific Antigen) and cytochemistry PAS (Periodic Acid of Shiff) in the recognition and identification of sperm in forensic samples for sexual violence in the Alberto Sabogal Soleguren National Hospital, 2017. The research is framed within the type of applied research, of nonexperimental design of correlational level since in this case the 2 variable is subjected to two methods, PSA immunocytochemistry and PAS cytochemistry, to determine the presence of sperm microscopically; the first method based on the antibody antigen reaction and a second method based on the chemical composition of the cells where the reaction of the mucopolysaccharides has been carried out: both tests standardized and carried out on positively charged plates From these methodological instruments the present investigation is constituted by 87 samples: 19 swabs vaginal secretion, 2 swabs anal secretion, 2 swabs perianal secretion, 10 intimate garments, 10 toilet paper, 10 sanitary towels, 10 swabs from the body region, 12 cotton fabrics, 12 synthetic fabrics. Subsequently, all the samples were processed in the positively charged sheets for the application of the PSA Immunocytochemistry and PAS Cytochemistry. The evaluation of films was previously validated by expert judgment, for greater rigor and reliability of the research. The statistical program IBM SPSS Statistics versión 24.0. was used for the hypothesis test. Concluding that this research is to provide the application of techniques of recognition of sperm confirmation where the forensic samples related to sexual violence, referred to the crime lab are processed with the study techniques allowing microscopic visualization and identifying the sperm in the minor time spent and with the highest sensitivity and specificity of the product found supporting the expert work of our country.Publicación Acceso abierto Aplicación del programa de rehabilitación y su influencia en la reducción de los niveles de agresividad en internos del centro penitenciario de chota – Cajamarca, año 2018(Universidad Privada Norbert Wiener, 2019-02-22) Flores Cabrera, Ruth Erika Analí; Quiroz Mejía, Jesús MiguelWith the present investigation the influence of the application of the rehabilitation program on the reduction of aggressiveness levels in inmates of the Chota - Cajamarca penitentiary center was determined. For this research, the following instruments were used: Cholera, Irritability and Aggressiveness Questionnaire, Buss-Durke Aggressiveness Inventory and the Rosenberg SelfEsteem Scale (RSES); the same ones that were applied before and after the development of said program. The sample consisted of 15 male participants, who were found as sentenced and in the process of being sentenced, to whom a pre-test and post-test were applied, applying before the latter, the program in question; it is thus that we would say that an experimental investigation was carried out. Among the results, there was an increase in the level of self-esteem in the beneficiary subjects. In the same way, as for the indicators of the study variables, it was possible to reeducate emotionally and increase the assertiveness levels in the internal participants of said Program; thus decreasing the levels of Physical Aggressiveness, Verbal Aggressiveness, Hostility and Anger.Publicación Acceso abierto Aplicación del reactivo fosfatasa acida de uso clínico para la determinación de presencia de fluido seminal con fines forenses en el laboratorio clínico H y D salud – 2021(Universidad Privada Norbert Wiener, 2022-03-11) Montenegro Villegas, Fany Yakeliny; Casana Jara, Kelly MilagritosSex crimes in our country according to statistical indices are high and are considered a public health problem that needs immediate attention, on the part of the entities that administer justice, using scientific evidence that helps to clarify said crimes, Therefore, we carried out the present investigation that aimed to evaluate the extent to which the acid phosphatase reagent for clinical use detects the presence of seminal fluid for forensic purposes in the Clinical Laboratory H Y D Salud– 2021. Regarding the methodology, is of an applied type, with a quantitative approach and an experimental design since numerical checks and statistical analysis were made to give a possible solution to the problem found through the manipulation of the variables; On the other hand, to collect the data, an observation card was used which was applied to the sample made up of the entire population, that is to say, census sampling, which in this case were 20 samples of seminal fluid in two types of fabric backing (cotton and synthetic). As results, it was obtained that the acid phosphatase reagent for clinical use detects the presence of seminal fluid in stock solution, 1/10 solution, 1/100 solution and 1/1000 solution both in synthetic cloth support and cotton cloth support; On the other hand, it was found that the acid phosphatase reagent for clinical use has significant differences in the detection of the acid phosphatase enzyme on cotton cloth support and on synthetic cloth support evaluated in the different solution groups. Accordingly, it was concluded to affirm the general hypothesis that the acid phosphatase reagent for clinical use detects the presence of seminal fluid for forensic purposes, both on cotton cloth support and on synthetic cloth support.Publicación Acceso abierto Árbol de decisión y la evaluación sexual no métrica del cráneo en una muestra contemporánea digital - Chachapoyas 2023(Universidad Privada Norbert Wiener, 2024-06-24) Manriquez Zapata, Héctor Miguel; Montellanos Cabrera, Henry SamThe objective of the study was to evaluate the relationship of the Decision Tree method and the Non-Metric Sex Assessment proposed by Langley to determine the true sex using a contemporary digital sample from the Province of Chachapoyas, Amazonas Region - Peru 2023. A quantitative study, since morphological dimensions of the skull were used to then quantify its characteristics, which were statistically analyzed for validation and effectiveness in reference to parameters established in the Langley method (2018). The sample was 80 digital images of skulls (ranging from 30 years to 50 years) following what was proposed by forensic identification techniques for determining sex in bone structures. As a technique, an exhaustive analysis of the skulls of a specific population was used to identify the sexual characteristics that allow sex to be determined (morphological characteristics of the glabella, zygomatic extension and mastoid process). For this reason, the understanding of how the chain of custody of indications and evidence was developed based on the experience of public servants and prosecutors of the Provincial Criminal Prosecutor's Office of Huancayo was developed and how it is related to crimes of simple homicide, qualified homicide and injuries. The present study had as methodological support the quantitative approach, of a basic or fundamental type, non-experimental design, whose population was made up of prosecutors from the Huancayo Provincial Criminal Prosecutor's Office and police officers who participate in the chain of custody process in crimes of homicide, abortion and injuries; The sample was made up of 80 professionals, including prosecutors and police officers; the technique used was the survey and the instrument was the questionnaire. Obtaining as results that there is a relationship between the chain of custody and the crime of simple homicide; Likewise, there is a significant correlation between the chain of custody and qualified homicide; and there is a significant correlation between the chain of custody and injuries.Publicación Acceso abierto La calidad de los informes periciales en sus diversas modalidades de falsificación de firmas en el departamento de grafotecnia de la Policía Nacional del Perú, Lima 2022(Universidad Privada Norbert Wiener, 2023-09-26) Oblitas Falero, Yesenia Elizabeth; Jáuregui Montero, José AntonioThe main objective of this research is to evaluate the quality of graphotechnical reports in the different modalities of signature forgery in the graphotechnical department of the National Police of Peru, Lima 2022. The methodology used had a qualitative approach with a phenomenological approach framework. The study scenario had a population of 19 graphophotechnical experts, from which six graphophotechnical experts were selected considering inclusion and exclusion criteria. The techniques used were conversation recordings and annotations. The results showed that the quality of the graphotechnical reports is guaranteed through the expert procedure governed by the criminalistics manual, using the graphoscopic method considering the analytical, comparative and conditional aspects with respect to the signatures, emphasizing also the due training and constant updates. To conclude, the entity lacks accreditation within the field of graphotechnics, the graphotechnical expert does not have certifications according to the ISO17024 standard, however, the specialists receive constant training and are governed by the procedures manual to carry out a quality scientific technical procedure based on the graphoscopic method indicated in the manual of criminalistics of the national police of Peru.Publicación Acceso abierto Capacitación en criminalística del personal fiscal y su relación con la investigación del delito de violación sexual en el distrito judicial de Lambayeque 2021(Universidad Privada Norbert Wiener, 2022-11-14) Castillo Méndez, Elvis Mayer; Casana Jara, Kelly MilagritosThe objective of this work is to determine the relationship between the criminalistics training of the Prosecutor's personnel and the investigation of the crime of rape in the Judicial District of Lambayeque; for which the hypothetical deductive method has been used; It is a quantitative research, the population is made up of 73 prosecutors; the Contingency Coefficient was applied; obtaining as a result that there is no relationship between being trained at the crime scene by the Prosecutor's staff and the investigation of the crime of rape in adults and minors in the Judicial District of Lambayeque; and this is due to the fact that the level of criminalistics training of prosecutorial personnel does not influence the investigation of the crime of rape; given that the results of the investigation will depend on a good handling of the crime scene by the forensic expertsPublicación Acceso abierto Características clínico-forenses en el abuso sexual en menores de edad evaluados en la Unidad Médico Legal Cajabamba, Perú 2018-2020(Universidad Privada Norbert Wiener, 2023-05-17) Tirado Romero, Manuel Bentura; Casana Jara, Kelly MilagritosChild sexual abuse (CSA) is a major global health problem, especially in low- and middleincome non-Western countries. The ASI is a very worrying phenomenon, however, the research on this topic in Peru is very scarce and more specifically in the different regions of the country, so in the present research work the forensic clinical characteristics of sexual abuse in minors are described. of age evaluated in the Legal Medical Unit (UML) Cajabamba (Peru) during the years 2018 to 2020; 164 legal medical certificates made by health professionals were analyzed. Among the findings we have: the average age of the minors was 12 years. 49.39% of the victims had primary education, of which 27.44% presented a recent tear, resulting in the most frequent type of hymen: the annular in 35.37%. On the other hand, 67.07% of the alleged attacks occurred on a working day and 31.10% of the alleged attacks were in a public place (outdoors such as in a park). The most frequent alleged aggressors were family acquaintances (31.71%). Lastly, in 38.41% of the presumed assaults, the presumed aggressor offered money. It is of type, applied (because it seeks to contribute to knowledge), descriptive correlational level, because it describes the relationship of two study variables, using the questionnaire technique and as an instrument and a checklist, validated by expert judgment. For this purpose, the population consisted of 198 students of the I.E. "June 24", and worked with the sample of 28 of the fourth grade of Secondary Education. In this sense, forensic psychology reports in cases of family violence, may or may not become true instruments of a rigorous nature in judicial processes, since in many of them the psychological antecedents of the aggressor, as well as the real psychological injuries of the victim. The research has a quantitative approach, the level of research is descriptive correlational and the research design is non-experimental; The sample is a census, in suchs as way thats all the units of the population will be taken as a sample and it is made up of 60 forensic psychologists from the Public Ministry of the Cajamarca region. The questionnaire was used as an instrument, and the technique was the survey. Basic-correlational, non-experimental, with a quantitative approach. Non-probabilistic-stratified sample, with 80 participants. For data collection, questionnaires were applied, which were validated and with high reliability, the Spearman Rho statistic was used for the general and specific inference tests. The results were: 40% of the operators have a low level, 32.50% have a medium level and 27.50% have a high level. Conclusion: there is a relationship (Rho = 0.946), significance p value = 0.000 <0.05 and high positive correlation, dismiss the null hypothesis. Significant relationship between crime scene knowledge and professional performance.
