El presente análisis jurídico tiene como finalidad estudiar el expediente penal N.º 04327 2016-57-2001-JR-PE-03, efectuado ante la Corte Superior de Justicia de Piura. El caso se enmarca en un proceso inmediato seguido contra los ciudadanos D.T.M. y C.S.S.M., a quienes se les atribuye responsabilidad penal por un hecho ilícito contra el patrimonio, en la modalidad de robo agravado en grado de tentativa, en perjuicio de la agraviada C.M.M.T. Los hechos se suscitaron en flagrancia delictiva, cuando los imputados intentaron arrebatar violentamente la cartera a la víctima, siendo posteriormente intervenidos por la policía y sometidos a proceso. Se han identificado dos problemas jurídicos: El primero: ¿Qué criterios jurisprudenciales ha emitido la Corte Suprema para dar por acreditado la violencia en el delito de robo? El segundo: ¿Qué parámetros viene utilizando el órgano jurisdiccional para vincular el resultado del examen del certificado médico legal con las lesiones descritas por la víctima en el delito de robo? En el informe concluimos: 1) Que la violencia exigida por el tipo penal de robo no exige necesariamente la presencia de lesiones visibles o de gravedad, sino que basta con que dicha violencia sea suficiente para vencer la oposición de la víctima. 2) El certificado médico legal representa un medio probatorio relevante, pero de no contar con él, la violencia se puede acreditar, con otros elementos de convicción, por ejemplo, con el testimonio de la víctima. 3) Se considera que la decisión emitida por la Sala Penal de Apelaciones es jurídicamente adecuada, al haber reconocido la existencia de violencia como medio empleado para intentar el apoderamiento, configurándose así el delito de robo agravado en grado de tentativa.
Resumen
The purpose of this legal analysis is to study criminal case file No. 04327 2016-57-2001-JR-PE-03, filed with the Superior Court of Justice of Piura. The case is framed within an expedited trial against citizens D.T.M. and C.S.S.M., who are accused of criminal responsibility for an offense against property, specifically attempted aggravated robbery, against the victim C.M.M.T. The events occurred in flagrante delicto, when the accused attempted to violently snatch the victim's purse, and were subsequently apprehended by the police and brought to trial. Two legal issues have been identified: The first: What jurisprudential criteria has the Supreme Court issued to establish violence in the crime of robbery? The second question: What parameters does the jurisdictional body use to link the results of the forensic medical examination with the injuries described by the victim in the robbery case? In the report, we conclude: 1) That the violence required by the crime of robbery does not necessarily require the presence of visible or serious injuries; it is sufficient that said violence be enough to overcome the victim's resistance. 2) The forensic medical certificate represents a relevant piece of evidence, but if it is not available, the violence can be proven with other elements of proof, for example, with the victim's testimony. 3) The decision issued by the Criminal Appeals Chamber is considered legally sound, having recognized the existence of violence as a means employed to attempt the appropriation, thus establishing the crime of aggravated robbery in the degree of attempt.
