Resumen
La presente investigación tuvo como propósito principal determinar de qué manera se debería acreditar mejor la comisión de los delitos ambientales que se cometen en los departamentos de Lima y Ucayali, para ello se plantea el objetivo de: evaluar la relación entre los peritajes ambientales oficiales emitidos por el Equipo Forense en Materia Ambiental del Ministerio Público y la investigación de delitos ambientales en los distritos fiscales de Lima, Lima Norte y Ucayali. Asimismo, el estudio aplica la metodología del enfoque cualitativo de tipo básica, ya que con esta metodología se evidencia una realidad, propiciando nuevas formas de comprender fenómenos, del mismo modo como población se tiene a los peritos forenses en materia ambiental del Equipo Forense en Materia Ambiental, los Fiscales Especializados en Materia Ambiental de Lima, Lima Norte y Ucayali y Jueces que conocen procesos penales ambientales. Por último, se estima que el presente estudio servirá como base para futuras investigaciones, habiéndose arribado a la conclusión que: el informe pericial oficial en delitos ambientales posee relevancia cuando cuenta con sustento técnico, normativo y científico, el uso de estos criterios en el peritaje permite determinar fehacientemente que el hecho investigado configura el tipo penal ambiental que ha sido imputado.
Resumen
The main purpose of this investigation was to determine how the commission of environmental crimes committed in the departments of Lima and Ucayali should be better accredited, for this purpose the objective is to assess: and assess the relationship between the official environmental expert reports issued by the Forensic Team in Environmental Matters of the Public Ministry and the investigation of environmental crimes in the fiscal districts of Lima, North Lima and Ucayali. Likewise, the study applies the methodology of the qualitative approach of basic type, since with this methodology a reality is evident, promoting new ways of understanding phenomena, in the same way as a population there are forensic experts in environmental matters of the Forensic Team in Environmental Matters, the Prosecutors Specialized in Environmental Matters of Lima, North Lima and Ucayali and Judges who know environmental criminal proceedings. Finally, it is estimated that this study will serve as a basis for future investigations, having reached the conclusion that: the official expert report on environmental crimes is relevant when it has technical, regulatory and scientific support, the use of these criteria in the expert opinion allows to determine irrefutably that the fact investigated configures the environmental criminal type that has been imputed.
