Resumen
Por medio del presente informe de carácter jurídico se analizará el desarrollo del procedimiento administrativo disciplinario correspondiente al Expediente N° 5963-2023-SERVIR/TSC, el cual se origina a raíz del reporte de una incidencia presentada por un personal de mantenimiento de Centro de Vacunación Externo del Hospital II - Clínica Geriátrica San Isidro Labrador de la Red Prestacional Almenara. Como consecuencia del reporte, la Secretaría Técnica de Procedimientos Administrativos Disciplinarios llevó a cabo una como primer acto una investigación preliminar conforme a sus funciones, la cual culminó con la respectiva emisión del documento del Informe de precalificación N° 094-STPAD-GRPA-ESSALUD-2022. Dicho informe, junto con la documentación pertinente y la recomendación de la sanción, fue remitido al Órgano Instructor competente, para que se pronuncie conforme a sus atribuciones. En virtud a ello, se pronunció mediante el informe del Órgano Instructor N° 01-JSE-D HIICGSIL-GSPN I II-RPA-ESSALUAD-2023, posteriormente se derivó al Órgano Sancionador, pronunciándose con la Resolución N° 57-ORH-GRPA-ESSALUD-2023, resolviendo imponer una sanción disciplinaria conforme a la normativa aplicable de suspensión por (15) días, sin oportunidad de goce de remuneración a la enfermera Betsy Roxana Chavez Gallegos, por haber cometido en el ejercicio de sus funciones en la Entidad la falta de naturaleza disciplinaria, debidamente tipificada dicha falta en el literal d) del artículo 85 de la Ley N° 30057 - Ley del Servicio Civil, por no haber mantenido el debido cuidado durante la manipulación del frasco de la vacuna de marca Sinopharm. Con fecha 25 de mayo de 2023, por medio del escrito presentado por la Licenciada Betsy Chavez Gallegos interpone recurso de apelación, argumentando principalmente que hubo una afectación al procedimiento que se le realizó, toda vez que hubo una carencia de motivación, así como también una deficiencia de razonabilidad al imputarle en el acto administrativo la sanción a la servidora. Finalmente, mediante la Resolución N° 003875-2023-SERVIR/TSC-Segunda, la Sala del Tribunal del Servicio Civil, se pronunció resolviendo declarar en la referida resolución la nulidad de la sanción impuesta a la Licenciada Betsy Chavez Gallegos mediante la Resolución N° 057-ORH-OA-GRPA-ESSALUD-2023, por lo que en base a ello, consecuentemente el Tribunal ordenó retrotraer el procedimiento, por la carencia de elementos esenciales para garantizar su validez jurídica establecidos en el ordenamiento jurídico. Entre los fundamentos de la nulidad se identificaron la falta de motivación, toda vez que no se desarrolló y motivó de manera adecuada la sanción impuesta a la servidora; asimismo, no se realizó idóneamente una motivación fundamentada al momento de imponer la sanción en la resolución administrativa emitida por el Órgano Sancionador. En ese tenor, se identificará y analizará las principales cuestiones de carácter jurídicos del caso en concreto, conforme a la doctrina y normativa actual.
Resumen
This legal report will analyze the progress of the administrative disciplinary procedure corresponding to File No. 5963-2023-SERVIR/TSC. This procedure arose from a report of an incident filed by maintenance personnel at the External Vaccination Center of Hospital II - San Isidro Labrador Geriatric Clinic of the Almenara Healthcare Network. As a result of the report, the Technical Secretariat for Administrative Disciplinary Procedures conducted a preliminary investigation as a first step in accordance with its functions, which culminated in the issuance of Prequalification Report No. 094-STPAD-GRPA-ESSALUD-2022. This report, along with the relevant documentation and the sanction recommendation, was forwarded to the competent Investigative Body for a ruling in accordance with its powers. Pursuant to this, the Investigative Body issued a report No. 01-JSE-D HIICGSIL-GSPN I II-RPA-ESSALUAD-2023, which was subsequently referred to the Sanctioning Body, which issued Resolution No. 57-ORH-GRPA-ESSALUD-2023, imposing a disciplinary sanction in accordance with the applicable regulations of suspension for (15) days, without the opportunity to receive pay, to nurse Betsy Roxana Chavez Gallegos, for having committed, in the performance of her duties at the Entity, an offense of a disciplinary nature, duly classified as such infraction in section d) of Article 85 of Law No. 30057 - Civil Service Law, for failing to maintain due care during the handling of the Sinopharm brand vaccine vial. On May 25, 2023, through a brief filed by Ms. Betsy Chavez Gallegos, she filed an appeal, arguing primarily that the procedure performed on her was jeopardized, given the lack of motivation and a lack of reasonableness in imputing the sanction to the employee in the administrative act. Finally, through Resolution No. 003875-2023-SERVIR/TSC-Second, the Civil Service Tribunal Chamber ruled, declaring the sanction imposed on Ms. Betsy Chavez Gallegos by Resolution No. 057-ORH-OA-GRPA-ESSALUD-2023 null and void. Therefore, the Tribunal ordered the procedure to be reversed due to the lack of essential elements established in the legal system to guarantee its legal validity. Among the grounds for the nullity were a lack of motivation, since the sanction imposed on the employee was not adequately developed and justified; likewise, a substantiated motivation was not adequately provided at the time of imposing the sanction in the administrative resolution issued by the Sanctioning Body. In this context, the main legal issues of the specific case will be identified and analyzed, in accordance with current doctrine and regulations.
